NARRATION:
On 12/17/07 at approximately 1430 hrs I received a telephone call from GRAVES informing me that BEENE had brought a roll -
off bin into the MRC facility. The bin was load- checked by an unidentified member of MRC's staff, and during the off - loading of
the bin, onto MRC's recycling pad, the staff member identified what they believed to be containers of hazardous waste.
GRAVES stated during his inspection of the load he observed two 5 gallon containers of Methyl Ethyl Ketone (MEK), which was
later determined to be one 5 gallon container of MEK with some residual still in the container. GRAVES was concerned about
multiple containers in the load, which were labeled `DEVMAT 101' with a hazard class rating of Corrosive 8/Toxic 6. 1 asked
GRAVES if he knew who the generator of the waste was. GRAVES stated BEENE told him the bin was taken from the KSI
Fabrication shop, located at 6205 District Blvd. GRAVES had notified KSI and told me they were en route to the facility to
perform the clean up and removal. I informed CAIVAS of the incident and was directed to respond to the incident location with
STARKEY.
STARKEY and I arrived on scene and were met by QUINTERO and GRAVES. STARKEY asked QUINTERO if the bin
contained waste generated by KSI and QUINTERO stated it had. QUINTERO informed STARKEY and I that the paint waste
and epoxies were used for maintenance of tanks used in oil field operations and that normally the wastes are stored in a booth
next to where the roll -off bin is located. 1 asked QUINTERO why the containers were put in the bin and QUINTERO told me KSI
employee(s) placed them in the bin. I asked QUINTERO how KSI normally disposes of it's paint waste and was told KSI
normally lets the paint dry and then put the dried containers into a roll -off bin for disposal. I told QUINTERO that KSI should
contact the Kern County Special Waste Facility and set up an account to have the wastes properly disposed of. QUINTERO
said he would look into the matter further.
QUINTERO stated that JASSO and BALENTINO would segregate the haz -waste from the other materials in the load and
transport those items back to the District Blvd. location. JASSO and BALENTINO donned tyvek suits, latex/rubber gloves, and
respiratory protection. During the segregation process the following items were identified: forty empty 5 gallon containers of
DEVMAT 101 (the empty containers were allowed to remain at the facility for recycling purposes), eight 5 gallon containers
(without lids) labeled `CONTROL TECH COR COTE HCRFF EPDXY' (1/ - 1/z full), one 5 gallon container (without lid) labeled
`ENVIROLINE EC 465' (1/4 full), one 5 gallon container (without lid) labeled `HI SOLIDS POLYURETHANE' (1 /a full), one 5 gallon
container (without lid) labeled `PHENICON HS EPDXY' (1/4 full), one 5 gallon container (without lid) labeled `ZINC CLAD
EPDXY' (gel), one 5 gallon container (without lid) labeled `MACROPDX 646 FAST CURE EPDXY' (dry, 1/4 full), one 1 gallon
container (without lid) of rust colored paint (3/ full), and two 5 gallon containers (without lids) labeled `DEVOE BAR -RUST 233H'
(semi - solid). Lids were placed on the open containers and the containers were put into a KSI service vehicle for transport.
During an inspection of the roll -off bin, paint waste was observed to be leaking from the southeast corner of the bin and had
leaked onto the pad. On the interior of the bin I observed paint waste in the southeast corner of the bin. JASSO and
BALENTINO used cloth rags to absorb the paint waste on the pad and inside the bin. The rags were placed in an empty 5
gallon container, secured with a lid, and placed into the KSI service vehicle.
STARKEY and I informed QUINTERO that by placing the paint waste, MEK, and epoxies inside the roll -off bin, and having the
materials transported to the MRC facility, that it constituted illegal disposal of a hazardous waste. I told QUINTERO that KSI
would need to identify all it's hazardous waste streams and properly manage it's waste. QUINTERO said he would address this
issue with KSI employees and develop policies and procedures to ensure similar instances like this do not occur in the future.
