HomeMy WebLinkAboutRES NO 165-17RESOLUTION NO. 16 5- 17 A RESOLUTION MAKING FINDINGS AND DETERMINATION REGARDING COMMITMENT OF UNEXPENDED METROPOLITIAN BAKERSFIELD TRANSPORTATION IMPACT FEES WHEREAS, the City adopted Ordinance No. 3736 amending Chapter 15.84 of the Bakersfield Municipal Code on December 4, 1996 in accordance with Government Code section 66000 et seq., for the purpose of providing funding for a regional transportation system consistent with the Circulation Element of the Metropolitan Bakersfield 2010 General Plan; and WHEREAS, the City has been collecting fees for regional transportation facilities in accordance with said Chapter 15.84 for over five years; and WHEREAS, State Government Code section 66001, requires local agencies "for the 5m fiscal year following the first deposit into an account or fund, and every five years thereafter, to include specified information in findings relating to the funding of a project." WHEREAS, if the local agency cannot demonstrate a need for unexpended or uncommitted fees collected pursuant to Government Code section 66000, the local agency shall refund said fees to current owners of property; and WHEREAS, attached Schedule "A" summarizes unexpended revenue collected in accordance with Chapter 15.84 and currently held by the City; and WHEREAS, the City determines said unexpended or uncommitted funds collected and held by the City are still needed for the purpose of funding a regional transportation system consistent with the Circulation Element of the Metropolitan Bakersfield 2010 General Plan; and WHEREAS, Schedule "A" summarizes the City's proposal as to how said unexpended fees will be committed; and follows: NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Bakersfield as 1. The above recitals, incorporated herein, are true and correct. 2. Fees collected and held by the City in accordance with Chapter 15.84 are deemed still needed and committed for the purpose of funding a regional transportation system consistent with the Circulation Element of the Metropolitan Bakersfield 2010 General Plan. 3.
