D. M. described on the attached Exhibit "A" and shown on Exhibit "B" complies with the provisions
of the Subdivision Map Act of the State of California and Chapter 16 of the City of Bakersfield
Municipal Code regulating divisions of land.
This certificate relates only to issues of compliance or noncompliance with the Subdivision
Map Act and local ordinances enacted pursuant thereto. The parcels described herein may be sold,
leased, or financed without further compliance with the Subdivision Map Act or any local ordinance
enacted pursuant thereto. Development of the parcels may require issuance of a permit or permits,

1. An easement for the construction and maintenance of pipe lines for the conveyance
of gas and incidental purposes, in favor of PACIFIC GAS AND ELECTRIC COMPANY, a
California corporation, in instrument recorded September 16, 1987, in Book 6048,
Page 1023, of Official Records, cannot be located from the record.
2. The following easements are of a nature which does not permit their mapping:
A) A Grant of Mutual Easement and Covenants Agreement dated September 3, 1987
between B.D.Benton and Tonia Benton and East Bakersfield Associates, a California
limited partnership, subject to the terms and conditions contained therein
recorded November 18, 1987 in Book 6067, Page 2227 of Official Records.
B) Easements, covenants, conditions and restrictions contained in that certain Grant of
Easements and Declaration of Covenants, Conditions and Restrictions executed by
East Bakersfield Associates, L.P., a California limited partnership,
recorded August 3, 1988 in Book 6149, Page 920 of Official Records.
C) A document declaring an amendment of said covenants, conditions and restrictions, recorded
November 2, 1988, in Book 6178, Page 733, of Official Records. A Supplemental
Declaration of Covenants, Conditions and Restrictions was recorded January 30, 1989, in
Book 6204, Page 1017 of of Official Records. An Amendment to supplemental
declaration of covenants, conditions and restrictions, recorded November 16, 1994
as Document No. 165980 of Official Records.
D) Construction, Operation and Reciprocal Easement Agreement dated August 3, 1988,
executed by and between East Bakersfield Associates, L.P., a California limited
partnership, which aquired title as East Bakersfield Associates, a general partnership,
(herein referred to as "Developer'), Mervyn's, a California corporation and Gottschalks Inc.,
a Delaware corporation in, upon and to all the terms, covenants, conditions, provisions,
reservation limitations, duties, obligations, liens, assessments and easements as more
fully described and set forth in said Agreement, recorded August 3, 1988 in Book 6149,
Page 970 of Official Records.
E) An Operation and Easement Agreement by and between Dayton Hudson Corporation
and East Bakersfield Associates, L.P., subject to the terms and conditions contained
therein, as disclosed by document recorded February 1, 1989 in Book 6205, Page 1649 of
Official Records. A First Amendement of Operation and Easement Agreement, was recorded
