The undersigned City Engineer of the City of Bakersfield, designated by ordinances of said City as Advisory
Agency with respect to Parcel Map Waivers and Lot Line Adjustments and acting herein on behalf of the City
of Bakersfield, hereby states that the Parcel Map Waiver for the hereinafter- describedpamels of land complies
with the provisions of the Subdivision Map Act of the State of California and Chapter 16 of the City of

Bakersfield Municipal Code,
WHEREAS, pursuant to Section 65870 et seq. of the California
Government Code, the City of Bakersfield has adopted Chapter 12.60
of the Bakersfield Municipal Codes permitting creation of required
easements by recorded Covenants,
NOW, THEREFORE, incorporating the foregoing provisions herein,
Richard A. Parrott, D.D.S. and Joe A. Parrott and Dorothy E.
Parrott by this Covenant do hereby create an easement for access
purposes over the following described portion of the burdened
property as described on Attachment 1 and shown on Attachment 2.

Upon recordation of the Covenant, the burdens of the easement shall
be binding upon, and the benefits shall inure to, all successors in
interest to the real property, until and unless the Covenant is

These protective covenants are for the purpose of defining the
maintenance factor of _.the described ingress - egress easement
across parcels A of Parcel Map Waiver 37 -90 and Parcel 2 of Parcel
Map Waiver.7 -93 for the benefit of Parcel 1 of Parcel Map Waiver 7-
93 as described in Exhibit "B ".
Maintenance: All maintenance of described ingress -
egress easement shall be the responsibility of each
parcel owner, parcel B sharing 658 of all costs, parcel
1 sharing 358 of all costs incurred.
Term: These covenants are to run with the land and shall
be binding on all parties and all persons claiming under
them for a period of twenty -five (25) years from the date
these covenants are recorded, after which time said
covenants shall be automatically extended for successive
periods of ten (10) years unless an instrument signed by
majority of the then owners of the lots has been recorded
agreeing to change said covenants in whole or in part.
In no event shall ingress and egress to Parcel 1 be
changed without written consent of the City of
Bakersfield.
3. Enforcement: Enforcement shall be by proceedings .,at law
or in equity against any Iperson or persons violating or
attempting to violate any covenants either to restrain
violations or to recover damages.

4. Severability: Invalidation of any one of these covenants
by judgement or court order shall in no,way affect any of
the other provisions which shall remain in full force and
effect. Breach of any of said covenants and
restrictions, or any re -entry by reason of such breach,
shall not defeat or render invalid the lien of any
mortgage or deed of trust made in good faith and for
value as to said lots or property, or any part thereof,
but such provisions, restrictions or covenants shall be
binding and effective . against any owner of said property
or otherwise.

to his sole and separate property, and JOE A. and DOROTHY E. PARROT, husband & wife as joint tenants.
It has been determined that the filing of a parcel map would serve no substantial public purpose. In
accordance with the provisions of the Subdivision Map Act and of Chapter 16 of the City of Bakersfield
Municipal Code, and subject in your conformance with the above - mentioned codes and your fulfillment of the

Upon your completion of the above - mentioned items and submittal of Exhibits "A" & "B ", properly
signed and sealed in accordance with the Land Surveyor's Act, along with a check made payable to the Kern
County Recorder to cover all costs of recording, this office will prepare a Certificate of Compliance for the
resulting parcels certifying that it conforms to the provisions of the Subdivision Map Act and local ordinance
relating to the division of land.
It should be noted that the preparation and recordation of a Certificate of Compliance shows that the
division of land conforms to the requirements of the Map Act only and should not be interpreted as the sole
requirement for obtaining construction permits.
A finding is hereby made that, upon your completion of the above- mentioned items and in accordance
with Section 66428 of the Subdivision Map Act, the division of land complies with such requirements as may
have been established by the Map Act or local ordinance enacted pursuant thereto as to area, improvement
and design, floodwater drainage control, appropriate improved public roads, sanitary disposal facilities, water
supply availability, environmental protection, and other requirements of this division or local ordinance
enacted pursuant thereto.
