OFFER OF SEWER AND DRAINAGE EASEMENT
WHEREAS, PINEVIEW LIMITED, A California Limited Partnership,
"Pineview" herein, is the owner of certain real property in the
City of Bakersfield, Kern County, California, described as follows:
I. I Parcel A and Parcel B of Parcel Map Waiver 26 -94 in the
�F Certificate of Compliance dated DECEMBER 12. 1994

WHEREAS, as a condition imposed upon Parcel Map Waiver 26 -94 by the
City Engineer of the City of Bakersfield, Parcel B therein shall
have the right to drain surface water over across and through
Whh Parcel A therein; and
.W WHEREAS, as a condition imposed upon Parcel Map Waiver 26 -94 by the
1 City Engineer of the City of Bakersfield, Parcel A therein shall
have the right to construct and maintain a private sewer line
across, over and through Parcel B therein; and
�. WHEREAS, Pineview has agreed that, upon conveyance of either Parcel
A or Parcel B a drainage easement over, across and through Parcel
A shall either be conveyed to the purchaser of Parcel B, or
reserved from the purchaser of Parcel A. The precise location of
said easement shall be at the sole discretion of Pineview, provided
z however, that such easement shall provide for the uninhibited use
thereof; and
WHEREAS, Pineview has agreed that, upon conveyance of either Parcel
A or Parcel B a sewer easement across Parcel B shall either be
--- conveyed to the purchaser of Parcel A, or reserved from the
purchaser of Parcel B. The location of such easement shall be at
the sole discretion of Pineview, provided however, that such
easement shall provide for the uninhibited use thereof.

NOW, THEREFORE, Pineview does hereby declare that this covenant is
non - revocable, and shall continue to burden and benefit the Parcels
of Parcel Map Waiver 26 -94, until such time as defined drainage and
sewer easements over Parcels A and B are granted to the respective
Parcels.
IN WITNESS WHEREOF, the undersigned, by its duly authorized

Commencing at the southwest corner of Lot 8 of Tract No. 4873
Unit 'A', in the City of Bakersfield, County of Kern, State of
California, as per map filed October 27, 1994 in Book 36, Page 86
of Maps, in the office of the County Recorder of said county;
thence North 0. 00' 11" East, along the west line of said Lot 8,
a distance of 837.98 feet, to the True Point of Beginning; thence
continuing North o• 00' 11" East, along said west line a distance
of 430.77 feet, to the northwest corner of said Lot 8; thence
South 88° 43' 34" East, along the north line of said Lot 8, a

California, as per map filed October 27, 1994 in Book 36, Page 86
of Maps, in the office of the County Recorder of said county;
thence North 0. 00' 11" East, along the west line of said Lot 8,
a distance of 837.98 feet; thence South 89' 59' 49" East a
distance of 180.65 feat, to the True Point of Beginning; thence
South 0' 00. 00" East a distance of 43.83 feet; thence South 45'

West a distance of 502.13 feet; thence South 69' 23' 44" West a
distance of 29.88 feet, more or less, to a point on the west line
