HomeMy WebLinkAboutORD NO 3071ORDINANCE NO. 3071 NEW SERIES AN ORDINANCE OF THE COUNCIL OF THE CITY OF BAKERSFIELD AMENDING TITLE SEVENTEEN OF THE BAKERSFIELD MUNICIPAL CODE BY CHANGING THE LAND USE ZONING OF THOSE CERTAIN PROPERTIES IN THE CITY OF BAKERSFIELD LOCATED SOUTH OF WHITE LANE, NORTH OF PACHECO ROAD BETWEEN S.P.R.R. AND SOUTH "H" STREET. WHEREAS, in accordance with the procedure set forth in the provisions of Title 17 of the Municipal Code of the city of Bakersfield, the Planning Commission has held a public hearing on a petition to change the land use zoning of those certain properties in the city of Bakersfield located south of White Lane, north of Pacheco Road between S.P.R.R. and South "H" Street; and WHEREAS, the Planning Commission, as a result of said hearing, did make several general and specific findings of fact which warranted a negative declaration of environmental impact and a change of zoning of the subject properties from an M-1 (Light Manufacturing) Zone to a C-2 (Commercial) and an R-2 (Limited Multiple-Family Dwelling) Zones, and the Council has considered said findings and all appear to be true and correct; and WHEREAS, there appears to be no substantial detrimental environmental impact which could result from the proposed pro- ject; and WHEREAS, the City Council has determined after due con- sideration of said petition and the recommendations of the Planning Commission herein on file, together with the reasons advanced at the hearing for a change of zoning of said properties, that a zoning change should be authorized; and ¢ WHEREAS, the City Council has determined and found that the proposed zoning is consistent with the General Plan of the city of Bakersfield. NOW, THEREFORE, BE IT ORDAINED by the Council of the City of Bakersfield as follows: 1. All of the foregoing recitals are hereby found to be true and correct. 2. An environmental assessment was made of the project, and a Negative Declaration was adopted by the Planning Commission after a public hearing thereon, and this Council hereby approves and adopts the Negative Declaration. 3. Section 17.06.020 (Zoning Map) of the Municipal Code of the City of Bakersfield be and the same is hereby amended by changing the land use zoning of certain properties in said City, the boundaries of which properties are shown on the map hereto attached and made a part hereof, as follows: FROM AN M-1 (LIGHT MANUFACTURING) ZONE TO A C-2 (COMMERCIAL), OR MORE RESTRICTIVE ZONE: Beginning at the northeast corner of Parcel 4 of Parcel Map No. 7353 recorded in Parcel Map Book 31 at Page 85 in the Office of the Kern County Recorder; Thence south 00°03'10" west, along the east line of said Parcel 4, 300.00 feet; Thence departing from said east line north 89°56'50" west, 510.41 feet to a point on the westerly line of said Parcel 4; Thence north 44°23'14" east, along said west line, 419.42 feet to the northwest corner of said Parcel 4, also being a point on the centerline of White Lane; Thence south 89°56'50" east, along the north line of said Parcel 4 and said cen- terline 217.30 feet to the Point of Beginning. Excepting therefrom those areas within the right-of-way of White Lane. Containing 2.5 acres. FROM AN M-1 (LIGHT MANUFACTURING) ZONE TO AN R-2 (LIMITED MULTIPLE-FAMILY DWELLING, OR MORE RESTRICTIVE ZONE: Commencing at the northeast corner of Parcel 4 of Parcel Map No. 7353 recorded in Parcel Map Book 31 at Page 85 in the Office of the Kern County Recorder; Thence south 00°03'10" west, along the east line of Parcel 4, 300.00 feet to the True Point of Beginning: Thence continuing along said east line south 00°03'10" west, 273.27 feet to the beginning of a curve concave northwest- erly and having a radius of 3,330.00 feet; Thence southwesterly along said curve through a central angle of 48°40'50" and an arc length of 280.38 feet; Thence south 48044'00" west, 427.44 feet to the beginning of a curve concave southeasterly and having a radius of 300.00 feet; Thence southwesterly along said curve through a central angle of 33°53'11" and an arc length of 177.43 feet to a point on the easterly line of Parcel 4; Thence south 14050'49" west, along the easterly line of Parcel 4, 91.86 feet; Thence continuing along said southeast line, north 75°09'11" west, 120.00 feet; Thence continuing along said east line, south 14°50'49" west, 335.00 feet to the southeast corner of Parcel 4; Thence north 75°09'11" west, along the south line of Parcel 4, 352.08 feet to the southwest corner of Parcel 4; Thence north 00002'47" west, along the westerly line of Parcel 4, 155.21 feet; Thence continuing along said westerly line, north 42052'05" east, 134.57 feet to the point of a non-tangent curve con- cave easterly having a radius of 75.00 feet and from which point a radial bears north 42~52'05" east; Thence northerly continuing along said westerly line and through a central angle of 119°30'06", an arc length of 156.43 feet; Thence along a radial of last mentioned curve and continuing along said westerly line, north 17°37'49" west, 310.37 feet; Thence continuing along said westerly line, north 44°23'14" east, 794.22 feet; Thence south 89056'50" east, 510.41 feet to the True Point of Beginning.
