The undersigned City Engineer of the City of Bakersfield, designated by
ordinances of said City as Advisory Agency with respect to Parcel Map Waivers
and Lot Line Adjustments and acting herein on behalf of the City of Bakersfield,
hereby certifies that the Parcel Map Waiver for the hereinafter - described parcels
of land complies with the provisions of the Subdivision Map Act of the State of
California and Chapter 16 of the City of Bakersfield Municipal Code regulating
divisions of land.
Said parcels of land, being situated in the City of Bakersfield, County of Kern,
State of California, are more particularly described as follows on Exhibit A and
shown on Exhibit B.
JOHN BARBER, as Trustee of the J. O. Barber Trust dated July 11, 1973, J. O.
BARBER or BEATRICE MAINE BARBER, as Trustees under the J. 0. BArber Family
Joint Trust Agreement, dated July 11, 1973, are the owners of the described
parcels of land.

WHEREAS John Barber as Trustee of the J. O. Barber Trust dated July
11, 1973, J. O. Barber or Beatrice Maxine Barber, as Trustees under the
J. O. Barber Family Joint Trust Agreement, dated July 11, 1973, are the
owners of certain real property in the City of Bakersfield, Kern County,
California, described as follows:
Parcels 1 & 2 of Parcel Map Waiver 24 -90 as shown on that
Certificate of Compliance recorded in Book 6Yc-EL, Page
-2}!�j and
WHEREAS, as a condition of approval of said Parcel Map Waiver imposed
by the Advisory Agency of the City of Bakersfield, an easement for
sewer line purposes shall be provided across a portion of Parcel 2 in
order to provide sewer service to Parcel 1 .
WHEREAS, to assure that there will be a means of providing sewer
service to said Parcel 1, John Barber has agreed that, upon conveyance
of either Parcel 1 or Parcel 2, an easement for sewer line purposes of
a minimum width of twenty-five (25) feet shall be reserved across a
portion of Parcel 2.
THEREFORE, upon sale of Parcel 1, an appurtenant sewer easement
across a portion of Parcel 2 will be conveyed to the purchaser of Parcel
1, or upon sale of Parcel 2, an easement will be reserved across a
portion of Parcel 2 for the benefit of Parcel 1, for the purpose of
providing sewer service to Parcel 1. The precise location of said
easement shall be at the sole determination of John Barber; provided
however, that such easement shall provide for uninhibited use thereof.

NOW, THEREFORE, John Barber does herebydeclare that this
covenant is non - revocable, and shall continue to burden and
benefit the several parcels within Pa cel Map Waiver 24 -90
per Certificate of Compliance, Book�,450 , Page�J -r until
such time as defined sewer service over Parcel 2 is granted
to Parcel 1.
IN WITNESS WHEREOF, the undersigned, by its duly author-
ized officers, has executed this instrument this 2 day of
November , 1990.
