A RESOLUTION DECLARING INTENTION TO
ESTABLISH THE EAST PANAMA LANE - CENTRAL
CANAL (NORTH HALF) BRIDGE DISTRICT AND
PRELIMINARILY APPROVING THE BOUNDARIES OF
THE AREA, CONSTRUCTION COSTS, AND FEE
SCHEDULE. (WARD 1)
WHEREAS, Chapter 16.32.060.F of Title 16 of the Bakersfield Municipal Code and
Section 66484 of the California Government Code, provides for a procedure by which
the City Council may assess and collect fees for the purpose of defraying the cost of
constructing bridges or major thoroughfares identified in the transportation circulation
element of the Metropolitan Bakersfield General Plan, and;
WHEREAS, Zone Change 05-1507 amended the zone district on approximately
110.44 acres located on the northeast corner of East Panama Lane and South Union
Avenue. Zone Change 05-1507 was adopted on March 8, 2006 by the City Council,
and;
WHEREAS, Vesting Tentative Tract Map 7029 was approved by the Planning
Commission on October 4, 2007, and;
WHEREAS, the developer, as a condition of approval for Zone Change 05-1507
and Vesting Tentative Tract Map 7029, is required to aid in the formation of a bridge
district and pay their proportional share of the cost to widen the East Panama Lane
crossing of the Central Canal, and;
WHEREAS the City of Bakersfield desires to aid the developer in the formation of
the East Panama Lane - Central Canal (North Half) Bridge District to fund the required
bridge widening, and;
WHEREAS, the City has notified all affected property owners and is proposing the
formation of the East Panama Lane - Central Canal (North Half) Bridge District to
reimburse the cost of the improvements upon subdivision or development of property
within the Area.
NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Bakersfield as
follows:
1. The foregoing recitals are true and correct and are incorporated herein.

2. The Council hereby preliminarily approves the estimate, attached hereto as
Exhibit A, the fee schedule attached hereto as Exhibit B, the limits of
improvements as shown on Exhibit C and the boundary of the area benefited by
the construction as described on the map attached hereto as Exhibit D, for the
East Panama Lane - Central Canal (North Half) Bridge District. Subdivision or
development of property within such Area will require payment of fees per the
attached schedule.
3. The City Council hereby fixes Wednesday, February 21, 2017 at 5:15 PM, or as
soon as thereafter as may be heard, at the Council Chambers of the City
Council, 1501 Truxtun Avenue, Bakersfield, California, as the time and place for
hearing protests on the following matters:
• Cost Estimate
• Fee Schedule
• Limits of Improvements
• Benefit Area
