4. NEW BUSINESS
A. Discussion Regarding the Massage Ordinance Penalties – Iger
Assistant City Manager Teglia introduced Deputy City Attorney Iger who
provided a brief presentation regarding the massage ordinance including
current problems and possible changes to the ordinance. Proposed changes
include: requiring individuals who own, manage, and or operate a massage
business to acquire an establishment permit for the location, require massage
therapists to acquire certification from the California Massage Therapy Council
(CAMTC), and to extend the denial, refusal, or revocation period from 90 days to
one year.
Committee member Sullivan thanked staff for the research and presentation.
Committee member Gonzales asked what enforcement policies are available to
assure that the property owners do not reopen as a massage establishment.
Deputy City Attorney Iger stated that enforcement and regulation could be
accomplished through the recently adopted Administration Citation Process. A
new establishment permit would be denied and not issued for the same location
where a previous establishment had their permit revoked.
City Manager Tandy inquired if the appeal process was changing.
Deputy City Attorney Iger stated there would be no changes to the appeals
process.
Bakersfield Police Sergeant Toler added that modifying the current requirement
to include individuals to acquire certification from CAMTC added an additional
layer of protection to the community in its efforts to prevent human trafficking
and prostitution. In addition, CAMTC provides ongoing educational training to
members of law enforcement as well.
Committee Member Sullivan made a motion to present a draft ordinance with
the proposed changes to the full City Council. The motion was unanimously
approved.

The meeting adjourned at 12:22 p.m.
