SECTIONS 17.60.110 O. AND 17.60.260 F. 7. TO THE
BAKERSFIELD MUNICIPAL CODE RELATING TO SIGNS.
BE IT ORDAINED by the Council of the City of Bakersfield as
SECTION 1.
Section 17.60.030 18. of the Bakersfield Municipal Code is
hereby amended to read as follows:
17.60.030 Definitions
18. a. "Freeway" means a highway in respect to which the
owners of abutting lands have no right or easement of access and which is
declared to be a freeway as provided by the Streets and Highways Code of
the state.
b. "Freeway oriented sign" means any freestanding sign
identifying premises where food, lodging and places of business engaged in
supplying goods and services essential to the normal operation of motor
vehicles and which are directly dependent upon an adjacent freeway. Such
signs must be located within a rectangular area 2000 feet in width and 3000
feet in length the center of which is concentric with the point of inter-
section between the centerlines of the freeway and surface street at those
locations where there is a separation of grades and access between the sur-
face street and the freeway. Maps delineating the specific rectangular
areas are contained in exhibit "A" on file in the Building Department. The
Building Director shall determine if the location of the business and the
service offered satisfy the criteria for a freeway oriented sign.
SECTION 2.
Section 17.60.070 N. of the Bakersfield Municipal Code is
hereby amended to read as follows:
Section 17.60.070 General prohibitions and restrictions.
N. Temporary signs as defined in subdivision 43 of Section
17.60.030 are prohibited, except that such signs may be used for the pur-
poses of commercial grand openings, special events of limited duration, and
like occasions. Each building or business shall be permitted temporary
signs for a maximum of two (2) such occasions per calendar year with a max-
imum duration of fifteen (15) days for each such permitted use, or four (4)
such occasions per calendar year with a maximum duration of seven (7) days
for each such permitted use. Flags and banners for tract sales offices and
model homes are not subject to the time limitation of this subsection.
SECTION 3.
Section 17.60.140 A. 6. of the Bakersfield Municipal Code is
hereby amended to read as follows:
Section 17.60.140 Permitted in C-O district
A. 6. One for sale or rent sign for each parcel of property, not to
exceed sixteen square feet in area, for each one hundred feet street front-
age, or portion thereof, with a maximum freestanding height of twelve feet
and a maximum height of fifteen feet, if attached to a building; the for
sale or rent sign permitted in the R-Z district shall not be permitted in
the C-O district in addition to such sign permitted in this section;
SECTION 4
Section 17.60.150 A. 3. a. ,d. and A. 7. a. ~. of the Bakersfield
Municipal Code is hereby amended to read as follows:
17.60.150 Permitted in C-1 district
3. a. One freestanding identification sign for each street

frontage of a developed parcel of property not exceeding one hundred fifty
square feet in area and which does not project over public property or any
public right-of-way, and is located not less than twenty-five feet from an
adjoining interior lot line; where such sign is a "freeway oriented sign"
the maximum area permitted shall not exceed three hundred fifty square
feet. If the only freestanding signs on the property, other than a shop-
ping center identification sign, are monument signs, as many as four such
signs are permitted along each street frontage, subject to the limitations
that no such signs shall be within 50 feet of any other such sign, no such
sign shall be within 25 feet of an interior side lot line, and no single
business, occupant, or activity shall be identified on more than one such
sign per street frontage.
3. d. Such signs shall not exceed twenty-six feet in height,
excepting "freeway orientea signs" which shall be permitted a maximum
height not to exceed seventy-five feet.
7. a. One for sale or rent sign for each building, the area of
which shall not exceed sixteen square feet for each one hundred front feet of
building occupancy. The maximum height of such sign shall not exceed
twelve feet;
7. b. When the parcel of property has no buildings on it, one
for sale or rent sign, not exceeding sixty-four square feet in area or four
or less such signs, none of which shall exceed sixteen square feet. The
maximum height of such signs shall not exceed twelve feet.
SECTION 5.
Section 17.60.160 A. 4. a. e. and A. 8. a. b. of the Bakersfield
Municipal Code is hereby amended to read as follows:
A. 4. a. One freestanding identification sign for each street
frontage of a developed property not exceeding two hundred forty square

feet in area and which does not project over public property or any public
right-of-way, and is located not less than twenty-five feet from an adjoin-
ing interior side lot line. Where such sign is a "freeway oriented sign"
the maximum area permitted shall not exceed three hundred fifty square
feet.
4. e. Such signs shall not exceed thirty-five feet in height,
excepting "freeway oriented signs" which shall be permitted a maximum
height not to exceed seventy-five feet.
8. a. One for sale or rent sign for each building, the area of
which shall not exceed sixteen square feet for each one hundred front feet
of building occupancy. The maximum height of such sign shall not exceed
twelve feet.
8. b. When the parcel of property has no buildings upon it,
one for sale or rent sign, not exceeding sixty-four square feet in area or
four or less such signs, none of which shall exceed sixteen square feet.
The maximum height of such signs shall not exceed twelve feet;
SECTION 6.
Section 17.60.170 A. 4. a.d. and A. 8. a. b. of the Bakersfield
Municipal Code is hereby amended to read as follows:
Section 17.60.170 Permitted in M-1 and M-2 districts.
A. 4. a. Two freestanding identification signs, not exceeding three
hundred square feet in area in aggregate, for each street frontage of a
developed parcel of property and which do not project over public property
or any public right-of-way, and are located a minimum of twenty-five feet
from an adjoining interior side lot line. Where such signs are "freeway
oriented signs" the maximum area permitted shall not exceed three hundred
fifty square feet in aggregate.

d. Such signs shall not exceed fifty feet in height, excepting
"freeway oriented signs" which shall be permitted a maximum height not to
exceed seventy-five feet.
8. a. One for sale or rent sign for each building, the area of which
shall not exceed sixteen square feet for each one hundred front feet of
building occupancy. The maximum height of such sign shall not exceed
twelve feet;
b. When the parcel of property has not building upon it, one for sale
or rent sign, not exceeding sixty-four square feet in area or four or less
such signs, none of which shall exceed sixteen square feet. The maximum
height of such signs shall not exceed twelve feet;
SECTION 7.
Section 17.60.110 O. is hereby added to the Bakersfield
Municipal Code to read as follows:
Section 17.60.110 Permitted in R-S, R-1 - 1A, R-S - 2~A,
12-S-5A, R-S-lO-A, and R-1 districts.
O. Flags and banners for tract sales offices and model
homes shall be permitted subject to the following:
1. A maximum of three flag poles shall be permitted on each
lot with a tract sales office or model home; provided, however, that
additional flag poles may be approved by the BZA,
2. The maximum flag pole heights shall not exceed twenty-
five feet above the adjacent grade,
3. The maximum signage area for each such pole shall not
exceed fifteen square feet,
4. Flags and banners shall be removed subject to the condi-
tions described in subdivision 5 of subsection F of Section 17.60.110.

SECTION 8
Section 17.60.260 F. 7. is hereby added to the Bakersfield
Municipal Code to read as follows:
17.60.260 Nonconforming signs.
F. 7. The foregoing notwithstanding, whenever there is a change
in ownership or tenancy of any business or tenant space within a shopping
center, new wall signage and/or a monument sign conforming to the require-
ments of this chapter to signify such change is permitted though noncon-
forming signage exists within such shopping center. No change of sign copy
to signify such change shall be permitted on any nonconforming sign.
SECTION g
This ordinance shall be posted in accordance with the City charter
provisions and shall become effective thirty (30) days from and after the
date of its passage.
