HomeMy WebLinkAboutROI NO 0920RESOLUTION OF INTENTION NO. 920 A RESOLUTION OF THE COUNCIL OF THE CITY OF BAKERSFIELD, DECLARING ITS INTENTION TO ORDER THE VACATION OF THE ALLEY EAST OF CHESTER AVENUE BETWEEN GENEVA AVENUE AND THE SOUTHERN PACIFIC RAILROAD. The Council of the City of Bakersfield, California, pursuant to the provisions of the "Street Vacation Act of 1941," being Sections 8300 or seq., of Division 9, Part 3 of the Streets and Highways Code of the State of California, does hereby resolve as follows: SECTION 1. That it is the intention of the Council of the City of Bakersfield to order the vacation of the alley east of Chester Avenue between Geneva Avenue and the Southern Pacific Rail- road, in the City of Bakersfield, County of Kern, State of California, more particularly described as follows: PARCEL 1 All that portion o west Quarter of th Township 30 South, of Kern, State of No. 33-55 ordering South "P" Street u No. 713 on file in of Bakersfield. the west 43 feet of the North - Southeast Quarter of Section 7, ange 28 East, M.O.M., County lifornia, lying between the of -way line of the Southern halto Branch and the north bandoned under Resolution he vacation of a portion of at Resolution of Intention he City Clerk's Office, City Reserving the east 5 feet of the north 94 feet of Parcel 1 for the purposes of a public utilities easement and also reserving the north 26.5 feet of Parcel 1 for the purposes of storm drain ease- ment. PARCEL 2 All that portion of the Northwest Quarter of the Southeast Quarter of Section 7, Township 30 South, Range 28 East, M.D.M., in the County of Kern, State of Califoruia, described as follows: A strip of Land 20 feet in width, the center line being parallel with and 275 feet northeasterly of, as measured at right angles to the center line of Chester Avenue, 110 feet in width. Excepting therefrom any portion lying in the south 198 feet of said Northwest Quarter of the Southeast Quarter of Section 7 and also excepting any portion lying in the west 43 feet of said Northwest Quarter of the Southeast Quarter of Section 7. Reserving the northeasterly 5 feet of Parcel 2 for purposes of a public utilities easement. That it is determined by the Council of the City of Bakersfield that the public convenience and necessity require the reservation of the aforementioned easement and the proceedings hereunder are taken sub- ject to such reservations and exceptions. For further particulars as to the proposed vacation, reference is hereby made to a map on file in the office of the City Clerk of the City of Bakersfield, in the City Hall, 1501 Truxtun Avenue, Bakersfield, California. SECTION 2. That the hour of 8 P. M., on the 6th day of June, 1977, in the Council Chambers in the City Hall, 1501 Truxtun Avenue, Bakersfield, California, be and the same is hereby fixed as the time and place when and where all persons interested in or object- ing to the proposed vacation may appear before the Council and offer evidence in relation thereto. SECTION 3. That the Superintendent of Streets of the City of Bakersfield, California, be and he is hereby directed to cause 'Notice of Street Vacation" to be posted as required by said "Street Vacation Act of 1941," being Division 9, Part 3 of the Streets and Highways Code of the State of California; and the Council of said City hereby elects to proceed under the provisions of said Act. SECTION 4. The City Clerk shall certify to the passage of this Resolution, and shall cause the same to be posted on the Bulletin Board at the City Hall, 1501 Truxtun Avenue, in the City of Bakersfield, California, within fifteen (15) days after its passage. ----------000---------- 2.
