AN ORDINANCE OF THE COUNCIL OF THE CITY OF
BAKERSFIELD ADDING CHAPTER 15.65 TO THE
BAKERSFIELD MUNICIPAL CODE PROVIDING FOR THE
RESPONSIBILITY OF HAZARDOUS MATERIALS
RELEASE RESPONSE PLANS AND INVENTORY.
WHEREAS, Health and Safety Code Section 25502(b) pro-
vides that a city may, by ordinance, assume responsibility for
the implementation of its provisions of the Health and Safety
Code commencing with Section 25500, Hazardous Materials Release
Response Plans and Inventory; and
WHEREAS, the City desires to place the responsibility
for the implementation of said sections of the Health and Safety
Code with the fire authority having jurisdiction within the City
boundaries.
NOW, THEREFORE, BE IT ORDAINED by the Council of the
City of Bakersfield as follows:
SECTION 1.

Purpose.
City enforcement.
County enforcement.
15.65.010 Pu__rpose.
The purpose of this chapter is to implement the
Hazardous Materials Release Response Plans and Inventory provi-
sions of the California Health and Safety Code commencing with
Section 25500.
15.65.020 City enforcement.
The Fire Department of the City of Bakersfield shall be
responsible for the implementation and enforcement of Chapter
6.95, commencing with Section 25500 of Division 20 of the
California Health and Safety Code in those areas for which the
city Fire Department has responsibility pursuant to Joint Powers
Agreement No. 80-70.
15.65.030 County enforcement.
The Fire Department of the County of Kern shall be
responsible for the implementation and enforcement of
Chapter 6.95, commencing with Section 25500 of Division 20 of the
California Health and Safety Code in those areas for which the
County Fire Department has responsibility pursuant to Joint
Powers Agreement No. 80-70.
SECTION 2.
This ordinance shall be posted in accordance with the
City charter provisions and shall become effective thirty (30)
days from and after the date of its passage.

and adopted by the Council of the City of Bakersfield at a regu-
lar meeting thereof held on the 5th day of November , 1986, by
