HomeMy WebLinkAboutORD NO 3077ORDINANCE NO. 3077 NEW SERIES AN ORDINANCE OF THE COUNCIL OF THE CITY OF BAKERSFIELD AMENDING SECTION 17.06.020 OF CHAPTER 17.06 (ZONING MAP) OF THE MUNICIPAL CODE OF THE CITY OF BAKERSFIELD REGARDING PREZONING OF PROPERTY KNOWN AS PANAMA NO. 7 ANNEXATION. WHEREAS, in accordance with the procedure set forth in the provisions of Title 17 of the Municipal Code of the City of Bakersfield, the Planning Commission held hearings on a request by the City of Bakersfield to zone certain property now being annexed to said City and made several general and specific find- ings of fact which warranted a negative declaration of environ- mental impact; and WHEREAS, there appears to be no substantial detrimental environmental impact which could result from this zoning action; and WHEREAS, the proposed zoning substantially conforms to the General Plan; and WHEREAS, the City Council has determined, after due con- sideration of the motion and recommendation of the Planning Commission, herein on file, together with the reasons advanced at the Planning Commission hearing, that said zoning should be authorized upon annexation of said property to the City. NOW, THEREFORE, BE IT ORDAINED by the Council of the City of Bakersfield as follows: A. All the foregoing recitals are found to be true and correct. B. The Negative Declaration for this zoning action is hereby approved and adopted. C. That Section 17.06.020 of Chapter 17.06 (Zoning Map) of the Municipal Code of the City of Bakersfield, be and the same is hereby amended by extending the boundaries of said map to include those certain properties in the County of Kern located north of Panama Lane and Fairview Road and west of Union Avenue and contiguous to the boundary of the City of Bakersfield known as the Panama No. 7 ANNEXATION, upon the annexation of said prop- erty to the City of Bakersfield, the boundaries of which property are shown on the map hereto attached and made a part of this ordinance, and are more specifically described as follows: TO AN R-1 (ONE FAMILY DWELLING), OR MORE RESTRICTIVE ZONE: Beginning at a point on the South line of Section 19, T.30S., R.28E., M.D.B&M., Kern County California, also being the center line of Panama Lane, from whence the southeast corner of said section bears East a distance of 266.75 feet; Thence West along said South line a dis- tance of 1,053.25 feet to a point on the West line of the East 1/2 of the Southeast 1/4 of the Southeast 1/4 of said Section 19; Thence North along said West line a dis- tance of 2,642.72 feet to Northwest cor- ner thereof also being a point on the center line of Fairview Road; Thence East along said center line a dis- tance of 1,262.25 feet to a point on the West right-of-way line of South Union Avenue also being the West line of the East 57.75 feet of said Section 19. Thence South along said West line a dis- tance of 2,403.60 feet, to a point on a line parallel with and 239.00 feet North of the South line of said Section 19; Thence West along said parallel line a distance of 209.00 feet; Thence South along a line parallel with the East line of said Section 19, a dis- tance of 239.00 feet to the point of beginning; Containing 75.43 acres -2- TO AN M-1 (LIGHT MANUFACTURING), OR MORE RESTRICTIVE ZONE: B-~ginning at a point on the center line of Fairview Road from whence the East quarter corner of said Section 19 bears East 638.24 feet; Thence West along said center line 681.76 feet to a point on the West line of the Southeast 1/4 of the Northeast 1/4 of said section; Thence North along said West line a dis- tance of 920.92 feet; Thence following the next (8) courses being parallel (more or less) with the East line of said Section 19 or the cen- ter line of Fairview Road; Thence East 601.05 feet; Thence South 128.00 feet; Thence West 111.50 feet; Thence South 132.00 feet; Thence East 172.23 feet; Thence South 330.93 feet; Thence East 19.58 feet; Thence South 330.00 feet to the True Point of Beginning; Containing 13.44 acres. TO AN M-2 (GENERAL MANUFACTURING), OR MORE RESTRICTIVE ZONE: The Southeast 1/4 of the Northeast 1/4 of said Section 19 EXCEPTING THEREFROM all of the aforedescribed M-1 Zoning area; Containing 24.85 acres. TO A C-2 (COMMERCIAL), OR MORE RESTRICTIVE ZONE: Beginning at a point on the South line of said Section 19 also being the center line of Panama Lane from whence the Southeast corner of said section bears East a distance of 266.75 feet; Thence North, along a line parallel with the East line of said Section 19, a dis- tance of 239.00 feet; Thence East, along a line parallel with the South line of said Section 19, a dis- tance of 209.00 feet to a point on the West line of the East 57.75 feet of said section; -3- Thence South along said West line a dis- tance of 239.00 feet to a point on the South line of said section; Thence West along said South line a dis- tance of 209.00 feet to the True Point of Beginning; Containing 1.15 acres. B. Haggin, Section 19, Township 30 South, Range 28 East, M.D.B.&M., Kern County, California filed May 3, 1889, in Book "M" of maps at page 5 in the Office of the Kern County Recorder. Said point of intersection being on the existing corporate boundary of the City of Bakersfield and is the point of beginning for this description; Thence (1) South on and along said South Union Avenue West right of way line and southerly projection thereof, a distance of 1321.30 feet to a point on the center line of Fairview Road; Thence (2) continuing South on and along said West right of way line and projec- tions thereof, a distance of 2672.60 feet to a point on the South right of way line of Panama Lane (60.00 foot wide road) also being the South line of the North 30.00 feet of said Section 30; Thence (3) West on and along said South right of way line, a distance of 1262.25 feet to a point on the southerly projection of the West line of the East 1/2 of the Southeast 1/4 of said Section 19; Thence (4) North along said West line and projection thereof a distance of 2672.72 feet to a point on the center line of Fairview Road; Thence (5) North along the West line of the Southeast 1/4 of the Northeast 1/4 of said Section 19, a distance of 1321.36 feet to a point on the existing Corporate Boundary of the City of Bakersfield; Thence (6) East on and along the last named Corporate Boundary to the point of beginning.
