Discussion Regarding Microbreweries in the Downton Area – Kitchen Community Development Director Kitchen provided a Power Point presentation summarizing the information provided in the memorandum included in the agenda packet regarding size limits, setbacks, off-site sales of microbreweries in the downtown area, including a draft ordinance. Committee Chair Freeman complemented staff on their research and compilation of information included in the memorandum provided in the packet. Committee Chair Freeman and Committee member Smith agreed that microbreweries should be allowed “by right” in the C-2 zones. Committee Smith requested staff correct the language in section 17.24.040 in the proposed ordinance. Committee member Smith also inquired about mechanical filtration systems and whether current microbreweries have them in place to deal with odors. He requested staff do additional research to determine if areas where microbreweries are located are experiencing significant odor issues. Community Development Director Kitchen stated that staff received no feedback from current breweries. Staff was able to the San Joaquin Valley Air Pollution Control District (District) who confirmed that applicable commercial projects, like large restaurants, obtain permits for mechanical filtration systems. The District does not currently monitor “Micro” facilities in part due to it being a relatively new industry and market. Committee member Smith requested the additional information regarding odors be presented to the full City Council; he made a motion to present the draft ordinance with the modification to allow microbreweries in C-2 zones “by right” to the full City Council. The motion was unanimously approved with Committee member Parlier absent. 5. COMMITTEE COMMENTS Committee member Smith requested staff review the State’s new Class IV Bike Facilities standards and incorporate them into the current update of the subdivision manual. He also asked about the status of the NACTO guidelines and when the item would be expected to return to the Committee for discussion. Public Works Director Fidler stated staff is in the final stages of updating the manual; staff will include the new Class IV standards. Assistant City Manager Huot added that both items are expected to return for discussion at an upcoming Committee meeting. Committee Chair Freeman asked if there are policies in place which reduce the speed limit on arterial streets. Public Works Director Fidler stated that the City follows the California Vehicle codes. Kitchen, Development Services Director MEMORANDUM TO: DATE: April 17, 2018 FROM: SUBJECT: Planning and Development Committee Jacqui Kitchen, Community Development Director Landscaping Standards - Council Referral No. 797 (All Wards) Councilmember Freeman referred the Planning and Development Committee to examine the development standards for landscaping in parking lots on commercial properties. 1.0 BACKGROUND Subsequent to the referral on February 21, 2018, City staff met with Councilmember Freeman to discuss the request further. Councilmember Freeman expressed concerns that the City’s current landscaping standards are insufficient in comparison to other Cities throughout the State. Councilmember Freeman provided photographs as examples, noted in Exhibit A and Exhibit B, below. Councilmember Freeman also requested that Staff review the standards for other Cities, and provided direction on components of the existing municipal code that should be changed (see Section 3). Source: http://bio-gardener.com/2009/11/tree-size-and-cost/ pg. 5 3.0 STAFF ANALYSIS As noted above, Staff received direction to amend sections of the existing Municipal Code to increase the existing landscape standards. The relevant topics and requested revisions are as follows: 1. Landscape Areas along Public Streets. Currently, any parking lot adjacent to a street must be buffered with a landscape strip, measuring ten-feet wide on arterial streets and eight-feet wide on collector and local streets. Requested Change: Increase minimum size to 15-feet wide for arterial and collector streets. 2. Parking Lot Screening. Currently, any parking lot with more than 10 spaces adjacent to a street must be screened by use of landscaped berms, retaining walls, hedges or combination thereof, at a minimum height of 24-inches. Requested Change: Increase minimum height to 48-inches. 3. Drive-Thru Screening. Currently, any drive-thru lane adjacent to a public street must be screened with an evergreen hedge or wall at a minimum height of three feet. Requested Change: Increase minimum height to five-feet. 4. Spacing of New Trees. Currently, new projects are required to plant trees at a minimum ratio of one tree per thirty-lineal feet, within the landscape strips. Requested Change: Increase planting ratio to one tree per fifteen-lineal feet. 5. Minimum Tree Size. Currently, new trees are required to be a minimum size of fifteen-gallon containers. Requested Change: Increase minimum size to 24-inch box. 6. Minimum Tree Size. Currently, new shrubs are required to be a minimum size of five-gallon containers. Requested Change: Increase minimum size to ten-gallon containers. Staff concludes that each of the requested changes would improve the aesthetic appeal of new developments throughout the City and may result in increased quality of life for Bakersfield residents. While the proposed changes typically would not apply to existing developments, they would apply to any new development. Staff also notes that the proposed changes would result in additional portions of private property being used for landscape areas and could result in increased development costs for property owners. Therefore, Staff has reached out to the Homebuilders Association, the Bakersfield Chamber of Commerce, and a variety of other commercial developers throughout the City to advise them of this potential change. The Police Department has indicated that the proposed 5-foot wall around drive-thrus is not consistent with “Crime Prevention through Environmental Design” practices; and recommends a four-foot wall as a compromise. Finally, Staff notes that the State of California has implemented the Model Water Efficient Landscape Ordinance (MWELO); which restricts the use of irrigation and prescribes design standards to reduce water use in landscaped areas. However, the proposed changes do not appear to conflict with the MWELO because the changes do not directly require increased water usage; and use of appropriate plant species can assure future compliance. 4.0 RECOMMENDATION For the reasons noted above, Staff recommends adoption of all Requested Changes, with the noted adjustment to the drive-thru section. Edits to the relevant Code Sections, as listed in Table 1, attached. pg. 6 Table 1. Mass shrub planting for area coverage may be a one-gallon container size with an average spacing of eighteen inches on center. Flats may be used for groundcovers with an average spacing of eight inches on center.” 17.61.030.E. “A landscaped area ten fifteen feet in width on arterial and collector streets and eight feet in width on collector and local streets as measured from the right-of-way line, shall be installed along said street. The width of the landscape strip may be reduced when, in the opinion of the planning director, the following conditions are met:” 17.61.030.F. “Along street frontages, a tree shall be planted at a ratio of one tree per thirty fifteen lineal feet, or portion thereof. Trees may be clustered or grouped to not conflict with required fire lanes, public entrances/exits, and signs provided the minimum tree to frontage ratio is satisfied. A species mix of thirty percent evergreen and seventy percent deciduous shall be maintained.” 17.61.030. N. “If a drive-thru lane is located adjacent to a public street, an evergreen hedge, a minimum of three four feet in height, shall be planted for screening purposes. This hedge shall be located between the drive-thru lane and public street along only that portion of the drive-thru lane that is adjacent to the public street. Designs standards for large retail 17.08.140.D.Parking Lot Design. No more than sixty percent of the off-street parking area for the entire area of land devoted to the large retail development shall be located between the front façade of the large retail development and the abutting streets unless the parking lots are screened from view by other freestanding pad buildings, or enhanced landscaping features with trees that incorporates berms at least three four feet high, plazas, water elements, or other such features that diminish the visual impression of a mass parking lot from the public right-of-ways. BAKERSFIELD POLICE MEMORANDUM 1 To: Jacqui Kitchen, Community Development Director March 30, 2018 From: Mike Hale, Captain Subject: Landscaping Standards - Council Referral No. 797 (All Wards) Upon review of the landscaping standards council referral the police department considered a philosophy of crime prevention through environmental design, known as CEPTD. Through CEPTD, natural surveillance is paramount for visibility for employees and patrons. Natural surveillance creates an environment that is not inviting for would be criminal activity. Criminals use cover and concealment to disguise illegal activity. Areas with foliage and or walls create space for subjects to loiter, which create quality of life problems. When employees and patrons can see their surroundings, criminals have pause when considering offending. The below picture depicts the view a driver would have from inside a sedan. The white vehicle in the drive thru is an SUV.
