employees against any and all liability, claims, actions, causes of action or derrends whatsoever against them, or any of them, before

from, the terms and provisions of this permit or the placement, use (by applicant or any other person or entity) or maintenance of said
anceaehmen4 whether or rot caused in part by a party indemnified hereunder, except for CITY's aok naive negligence or willful
misconduct- The applicant further agrees to maintain the aforesaid encroachment during the fife of the said encrrouhment or mtif such
time that this permit is revoked.
Applicant further agrees that upon the expiration of the permit for which this application is nude, if granted, or upon revocation thereof by
the City Engineer, applicant will at his own cost and expense remove the same font the public property or right of way where the same is
located, and restore will public poperty or right of way b the condition as nearly as that in which it was before the placing, erection,

Applicant further agrees to obtain and keep all liability insurance required by the City Engineer in full force and effect for however IMS

Pursuant to the provisions of Chapter 12.20 of the Bakersfield Municipal Code, the undersigned applies for a permit to

Applcant agrees that if this application is granted, applicant shall Indemnify, defend and hold harmless the City, its
officers agents and employees against any and all liability, claims, actions, causes of action or demands, whatsoever
against them, or any of them, before administrative, quasi- judicial, orjudlcial tribunals of any kind whatsoever, arising out
of, connected with, or caused by applicants placement, erection, use (by applicant or any other person or entity) or
maintenance of said encroachment. The applicant further agrees to maintain the aforesaid encroachment during the life
of said encroachment or until such time that this permit is revoked.
Applicant further agrees that upon the expiration of the permit for which this application is made, if granted or upon the

The enclosed application for encroachment permit and check In the amount of $208.00 is in response to a
request from Mr. Wayne Lawson — Assistant Planner with the City of Bakersfield. Following Mr. Lawson's
review of the permit addendum submittal, Mr. Lawson Instructed us to contact the Bakersfield Public Works
Department for an additional review.
A review was conducted by the Bakers0eld Public Works Dept and Mr. Jim Holladay at PWD Instructed us to
file for an encroachment permit on behalf of AT &T, The encroachment permit will allow AT &T to park a
temporary portable emergency generator next to the side walkyourb on Eye street for an Indefinite period of
time. The portable generator would be needed by AT &T In the event of an emergency or loss of commercial
electrical power at their facility.
Mr. Holladay provided us with the encroachment permit application forms and Instructed us to send the
completed application and fee to the building department for processing.
This cover letter Includes the following attachments:
1. Application for Encroachment Permit
2. 8 'h x 11 Site Plan GO indicating the location of the proposed encroachment
3. 8 'h x 11 enlargement of site plan GO with photo of existing outside wall vent
4. Certificate of Insurance cover letter from AT&T Risk Management

6. Salas O'Brien Engineers Check In the amount of $208.00
