Notable Items  North Star, the consultant contracted by the Regional Branding Initiative Steering Committee, is seeking widespread promotion of its recently released community survey. The survey is designed to be completed by as broad of a cross-section of the community as possible, and it hopes to receive several hundred responses. The survey can be taken on their website, www.bakersfieldkerncountybrands.com. Any help to spread the word is greatly appreciated. The deadline to complete the survey is Thursday, May 31st.  The City’s 10 water spray parks will open this Saturday, May 26th, and operate from 1:00 p.m. until 6:00 p.m. daily through September 3rd. This day of activities include games and information on water safety. The cost is $4 per person or $13 for groups of four people. See the attached flyer for more information. The Thousand Flags Event, presented by the Bakersfield Breakfast Rotary Club, will occur this weekend, May 26th to 28th. Activities are scheduled throughout the weekend, with the Patriotic Fair occurring on Monday from 10:00 a.m. to 3:00 p.m. More information is available at the event website: www.thousandflags.org Last weekend, two large sporting events were held in Bakersfield, each facilitated by Visit Bakersfield. At Bakersfield College, the California Community College Athletic Association’s State Track and Field Championships took place on Friday and Saturday. Finally, the USA BMX Golden State Nationals were a huge success, which attracted between 1,500 and 1,800 riders from across the nation. Council Referral Councilmember Gonzales o Referral No. 800 – Special Event Permit for Street Closures Traffic Advisories Nighttime Lane and Ramp Closures for the Week of May 28 The following nighttime lane and ramp closures are planned for State Route 58, State Route 99, and Union Avenue from Tuesday, May 29th, through Thursday, May 31st. These closures are expected to be in place between the hours of 9:00 p.m. and 5:00 a.m. each night. At least one travel lane will remain open to traffic while work is underway, but motorists will need to use an adjacent interchange to enter or exit the freeway during ramp closures. The following closures are for electrical work, unless otherwise indicated. Smith, Finance Director DATE: May 25, 2018 SUBJECT: Council Referral No 800 – Special Event Permit for Street Closures Councilmember Gonzales requested staff to research potential improvements to the special event permit processing and approval regarding street closures. As an overview, the Finance Department, Treasury Division, coordinates the review and approval process for special event permits. Applications are routed to various City departments for review and approval, including Police (Traffic Division), Development Services (Planning Division), City Manager’s Office (Risk Management) and Public Works (Traffic Division). Following each departments review and approval of an application, the Treasury Division issues a permit. Furthermore, the Bakersfield Municipal Code (BMC) Chapter 10.69 details the procedures and requirements for processing and approving special event permits. The City has issued approximately 70 special event permits over the past 2½ years. The vast majority of these events have been well received with little to no concerns reported. The recent downtown event for the National Day of Prayer was an exception to the City’s past experience and drew complaints from local business owners and nearby residents. The vast majority of the comments revolved around the lack of notification to the impacted businesses regarding the planned street closure and the length of time the streets were closed prior to the start of the event. The BMC Section 10.69.030(C) includes: The applicant shall notify all business owners located adjacent to any right-of- way which will be closed for the event. Proof of written notice shall be submitted to the City Manager or designee. In addition, as part of the application, the applicant/event organizer both initial and sign an agreement that specifically states: I agree to notify all residents and businesses that will be affected by street/sidewalk closures and/or amplified sound. The applicant shall notify all business owners located adjacent to any right-of-way which will be closed for the event. Proof of written notice shall be submitted to the City Manager or his designee. (BMC 10.69.030(C)) If the event will affect access to more than one business, the applicant must notify the Greater Bakersfield Chambers of Commerce. Notification also includes the posting of temporary “No Parking” signs on streets involved in closures for the event. The City’s past practice has been to collect a copy of the notice from the applicant they planned to use to notify the impacted residents/businesses. In regard to the National Day of Prayer event, it appears the applicant may not have provided adequate notification. City staff involved in the review of traffic flow should, whenever possible, suggest alternatives to street closures for events that might be accommodated in a city park or other suitable location. In the event a street closure seems to be the most appropriate venue for the event, City staff should be able to ensure the applicant is in compliance with the existing rules and guidelines. In an effort to safeguard against future issues regarding notification of impacted residents and business owners, City staff has researched best practices of other cities. Both the cities of Riverside and Visalia require the applicant to obtain signatures of the impacted residents and businesses regarding potential street closures and submit those signed forms to the City as proof of notification. Attached you will find a draft notification form. Inclusion of said form as part of the application process is consistent with both the BMC and existing instructions. This additional step adds a level of certification to the compliance of the existing rules. Also, City staff recommends the Bakersfield Chamber of Commerce be provided notification of any event that impacts more than one business. Please note this action may not be reasonably applied to all special event permit requests (Bakersfield Marathon, etc.); however, it could be applied to smaller events involving limited street closures. Finally, City staff should involve the City Manager’s Office in the review process if an application is considered unusual or complicated. Attachment 1.
