Applicant agrees that if this application is granted, applicant shall indemnify, defend and hold harmless the City, its
officers agents and employees against any and all liability, claims, actions, causes of action or demands, whatsoever
against them, or any of them, before administrative, quasi-judicial, orjudicial tribunals of any kind whatsoever, arising out
of, connected with, or caused by applicant's placement, erection, use (by applicant or any other person or entity) or
maintenance of said encroachment. The applicant further agrees to maintain the aforesaid encroachment during the life of
said encroachment or until such time that this permit is revoked.
Applicant further agrees that upon the expiration of the permit for which this application is made, if granted or upon the

Dear Mr. Escamilla:
We have reviewed your application for an encroachment permit, for a fence
With brick columns at 4001 Peachwood Court. Based on a site review, because of the
driveway adjacent to the north at 3909 Peechwood. Court your fence will need to
follow aclear line of sight as detailed in Section 17.08.1758 of the Bakersfield Municipal
Code. Included isa copy of the section of the municipal code for your information
along with the line of sight detailed on the drawing you submittedwith your
application. The sight line gives the resident at 3909 Peachwood Court clear view of
any oncoming traffic while exiting their driveway.
Please notify our office, at your earliest conveyance, if this change is acceptable
and we can complete your application approval, if not your application will be denied.

A. On all corner lots located on uncontrolled intersections, no obstruction to motor vehicle driver views in excess of three
feet higher than curb flow line grade shall be placed on any corner or reversed corner lot within a triangular area formed by the
intersecting street curblines and a line connecting them at points sixty feet from their intersection point.
B. On all lots abutting an alley or driveway, no obstruction to sight view shall be permitted within the triangular area formes

Bob, after visiting the site, I have no problem approving the fence as it sits. There will be wrought iron installed between
the brickpillars that will allow the neighbor backing out to see. Also, the neighbor has a dozen or so large rose bushes
adjacent to the fence that already obstructs their view backing out; even without the new fence there (see attached
photos).
I approve the encroachment permit without a fence modification. The required line -of -site is not obstructed by the
fence installation.
