Applicant agrees that if this application is granted, applicant shall indemnify, defend and hold harmless the City, its
officers agents and employees against any and all liability, claims, actions, causes of action or demands, whatsoever
against them, or any of them,. before administrative, quasi-judicial, or judidial tribunals of any kind whatsoever, arising out
of, connected with, or caused by applicants placement, erection, use (by applicant or any other person or entity) or
maintenance of said encroachment. The applicant further agrees to maintain the aforesaid encroachment during the life
of said encroachment or until such time that this permit is revoked.
Applicant further agrees that upon the expirationof the permit for which this application is made, if granted or
revocation thereof by the City engineer, applicant will at his own cost and expense remove the same from

Enclosed is our application foran encroachment permit, the encroachment permit fee and
a copy of our homeowner's insurance policy. The existing wrought iron fence replaces a
prior wooden fence.
Also included is a drawing showing the encroachment in relation to the existingcurb,
gutter, sidewalk and setback distance as well as pictures of the fence from several.
directions. Signatures from affected neighbors have been collected. The enclosed
pictures will show that we are a corner house with one adjoining neighbor and one
"across the street" neighbor. The south side of Wilson Road is occupied by the Dante
Hall and The Salvation Army.

ADDITIONAL PROPERTY COVERAGES
The following is added:
11. Fungi, Wet or Dry Rot, or Bacteria. We will pay up to $10,000 for:
a. the direct physical loss to covered property caused by fungi, wet or dry rot, or bacteria;
b. the cost to remove fungi,wet or dry rot, or bacteria from covered property;
C. the cost to tear out and replace any part of the building or other covered property as needed to
gain access to the fungi, wet or dry rot, or bacteria;
d. the cost of any testing of air or property to confirm the absence, presence or level of fungi, wet
or dry rot, or bacteria, whether performed prior to, during or after removal, repair, restoration or
replacement. The cost of such. testing will be provided only to the extent that there: is a reason to
believe there is the presence of fungi, wet or dry rot, or. bacteria; and
e. Additional Living Expenses or Fair Rental Value loss covered under Coverage .D—Loss of
Use.
This coverage only applies when such loss or costs:
f. are a result of a loss we cover that occurs during the policy period;
g. are not excluded under Building Property Losses We Do Not Cover; and
In. only if all reasonable means are used to save and preserve the property fromfurther damage..
This coverage does not apply to loss to trees; shrubs, or other plants.
The $10,000 limit of liability is the most we will pay for the total of all loss or costs for Coverages A,
B, C and D, and does not increase the limit of liability for these coverages, regardless of the number
of locations or number of claims made.
POLICY DEFINITIONS
The following is added:
16. "Fungi" means any type or form of fungus, including yeast, mold or mildew, blight or mushroom and
any mycotoxins, spore, scents or other substances, products or byproducts produced, released by or
arising out of fungi, including growth, proliferation or spread of fungi or the current or past presence
of fungi. However, this definition does not include any fungi intended by the insured for
consumption.
