Applicant agrees that if this application Is granted, applicant shall indemnify, defend, and hold harmless CITY, its officers, agents
and employees against any and all liability, claims, actions, causes of action or demands whatsoever against them, or any of
them, before administrative or judicial tribunals of any kind whatsoever, arising out of connected w8h, or caused by applicant,
or in any way arising from, the terms and provision of this permit or the placement, use (by applicant or any other person or
entity) or maintenance of said encroachment, whether or not caused in part by a party indemnified hereunder, except for CITY'S
sole active negligence or willful misconduct. The applicant further agrees to maintain the aforesaid encroachment during the life
of the said encroachment or until such time that this permit is revoked.
Applicant further agrees that upon the expiration of the permit for which this application is made, if granted, or upon revocation
thereof by the City Engineer, applicant will at his own cost and expense remove the same from the public property or right of way
where the same is located, and restore said public property or right of way to the condition as nearly as that in which it was
before the placing, erection, maintenance or existence of said encroachment,
Applicant further agrees to obtain and keep all liability insurance required by the City Engineer in full force and effect for however
tong the encroachment remains. Applicant shall furnish the City Risk Manager with a certificate of issuance evidencing sufficient
coverage for bodily injury or property damage liability of both and required endorsements evidencing the insurance required.

CITY OF BAKERSFIELD ADOPT A HIGHWAY
SERVICE AGREEMENT
THIS AGREEMENT is made and entered into on g;Up 2 7m2 , by and
between the CITY OF BAKERSFIELD, a Charter city and municipal
corporation, ("CITY" herein) and KEEP BAKERSFIELD BEAUTIFUL, a committee of
volunteers, ("VOLUNTEER" herein).
RECITALS
WHEREAS, VOLUNTFFR requests of CITY that VOLUNTEER be allowed to
adopt a street and roundabout for beautification and clean-up purposes; and
WHEREAS, VOLUNTEER wishes to keep Bakersfield, California, clean and
beautiful; and
WHEREAS, CITY wishes to keep Bakersfield, California,. clean and beautiful;
WHEREAS, at VOLUNTEER's request CITY will include VOLUNTFERin its Adopt
A Highway Program.
NOW, THEREFORE, incorporating the foregoing recitals herein, CITY and
VOLUNTEER mutually agree as follows:
1. SERVICES. VOLUNTEER will provide services as per the adopted
guidelines and policies of the Adopt A Highway Program for two (2) years from
the date of this Agreement. Copies of the guidelines and policies are attached
as Exhibit "A," and made a part of this Agreement as though fully :set forth.
VOLUNTEER agrees to follow said guidelines. VOLUNTEER further agrees to follow
instructions given by CITY for the clean-up task VOLUNTEER has been assigned.
2. LOCATION/TIME. VOLUNTEER hereby adopts the following locations
as the area for cleanup and beautification purposes: The Garces Circle
roundabout and Chester Avenue between Garces Circle and California
Avenue.
3. RECOGNITION. VOLUNTEER shall receive appropriate recognition
for the Adopt A Highway Program inappropriate CITY publications.

4. TERMINATION. This Agreement may be terminated by any party
upon ten (10) days' written notice, served by mail or personal service, to all
other parties.
5. NO COMPENSATION. VOLUNTEER agrees in all work performed
hereunder VOLUNTEER shall receive no compensation from CITY. VOLUNTEER, is
not an employee of the CITY for any purpose and is not entitled to any of the
benefits provided by CITY to its employees including, without restriction, workers'
compensation benefits, insurance, or salary.
6. CITY MAINTENANCE: CITY will maintain the adopted locations
according to normal CITY procedure and policy. Maintenance may include,
but not limited to, the removal of dead, dying or diseased plants.
7. WAIVER OF LIABILITY. VOLUNTEER agrees to sign the Waiver of
Liability attached hereto as Exhibit "B," and incorporated herein by reference as
though fully set forth. VOLUNTEER agrees to have each individual, participating
on behalf of VOLUNTEER in the Adopt A Highway Program, sign the attached
Waiver of Liability. VOLUNTEER fully understands that performance of the
services specified in this Agreement may involve some risk of injury to
VOLUNTEER.. VOLUNTEER, by signing the Waiver of Liability, agrees to assume all
risk which accompany the performance of the services rendered by VOLUNTEER
and VOLUNTEER will make no claim of any kind against the CITY, its agents or
employees,. for any injuries which may arise from the performance of
VOLU NTFFR's services.
6. ADULT SUPERVISION. At all times, VOLUNTEER shall provide
adequate adult supervision for minors participating in the clean-up and/or
beautification project.
9. BINDING EFFECT. The rights and obligations of this Agreement shall
inure to the benefit of; and be binding upon, the parties to the Agreement and
their heirs, administrators, executors, personal representatives; successors and
assigns.
10. NOTICES. All notices relative to this Agreement shall be given in
writing and shall be personally served or sent by certified or registered mail and
be effective upon actual personal service or depositing in the United States
.mail. The parties shall be addressed as follows, or at any ether address
designated by notice:

10. NO PARTNERSHIP. CITY shall not be deemed a partner or joint
venturer with VOLUNTEER.
11. COMPLIANCE WITH ALL LAWS. VOLUNTEER shall, at VOLUNTEER'S
sole cost, comply with all of the requirements of. Municipal, State, and Federal
authorities now in force, or which may hereafter be in force, pertaining to this
Agreement, and shall faithfully observe in all :activities relating to or growing out
of this Agreement all Municipal ordinances and State andFederal statutes, rules
or regulations, and permitting requirements now in force or which may hereafter
be in force including, without limitation, obtaining a City of Bakersfield business
tax certificate )Bakersfield Municipal Code Chapter 5.02) where required.

GUIDELINES AND POLICIES
FOR ADOPT A HIGHWAY VOLUNTEER(S)
WHAT: Pick up trash/litter. Maintain any plants or flowers VOLUNTEER may
put in place with CITY approval, i.e. water and weed. Maintain
any lighting fixtures VOLUNTEER may put in place with CITY
approval, i.e. decorative lighting to spotlight the statue of Father
Garces. Maintain any other landscape features VOLUNTEER may
put in place with CITY approval, i.e. a planter box. VOLUNTEER will
seek additional approval from an appropriate entity, if applicable.
WHERE: The Garces Circle roundabout and Chester Avenue between
Garces Circle and California Avenue
WHEN: At least 4 times per year for litter trash/litter clean-up. At least I time
per month for maintenance check or maintenance work, i.e.
repairs, watering, weeding, etc.
HOW: By hand using City -issued gloves, vests, and trash bags. (Contact
City of Bakersfield. Solid Waste Division at 326-3114 for details.) Trash
bags should be left adjacent to existing. public garbage cans, in
trash bins at City Hall, or curbside within adopted boundary.
• DO NOT go into or clean street medians (islands in the rniddle of the street)
except for additions VOLUNTEER may make to adopted roundabout.
a DO NOT clean bathrooms.
e DO NOT pick up anything that looks dangerous (syringes) or that makes you
feel uncomfortable.
® DO NOT bring or use your own supplies or tools.
REMEMBER: it is the responsibility of VOLUNTEER to provide adequate
adult supervision for minors participating in the clean-up. Please
remember to follow all traffic and pedestrian laws and USE CAUTION AT
ALL TIMES,
