Applicant agrees that if this application is granted, applicant shall indemnify, defend and hold harmless the City, its
officers agents and employees against any and all liability, claims, actions, causes of action or demands, whatsoever
against them, or any of them, before administrative, quasi-judicial, orjudicial tribunals of any kind whatsoever, arising out
of, connected with, or caused by applicant's placement, erection, use (by applicant or any other person or entity) or
maintenance of said encroachment. The applicant further agrees to maintain the aforesaid encroachment during the life of
said encroachment or until such time that this permit is revoked.
Applicant further agrees that upon the expiration of the permit for which this application is made, if granted or
property or riehtof way where the same is located, and restore said public property or right of way to the condition as
nearly as that in which it was before the piecing, erection, maintenance or existence of said encroachment.
Applicant further agrees to obtain and keep all liability insurance required by the City Engineer in full force and effect for
however long the encroachment remains. Applicant shall furnish the City Risk Manager with a Certificate of Insurance
evidencing sufficient coverage for bodily injury or property damage liability or bath and required endorsements evidencing

To Whom It May Concern,
This is a request in conjunction with proposed facade remodel of existing Papayas fast food restaurant
structure located as above address.
A new nationwide program to upgrade the look of their existing, older locations is under way. It has just
reached Southern California and the Bakersfield location at the address above is amongst the first in line
with the new facade upgrade/ remodel plans. The new prototypical design of facade remodel callsout
for 3 new "tower" like structures to be added to the face of existing facade to give the structure a more
pleasing. and architecturally significant aesthetic. Two of these towers are located and accentuate the two
existing. entries (Front and main and side/ Secondary). The other one is located above the "Drive -
Through" area and includes a decorative balcony with metal railing. This application concerns with
projection of one of the new "Towers" at the side entrance ("First Street" side, facing South) over existing
property line. The other two are away from the property line by quite a distance and are within
acceptable set backs.
The existing structure's exterior wall sits right at the Properly Line on the South side ("Fist Street" side).
There is an existing Mansard Roof on topping the existing structure that spans about 4 feet from face of
building at all four sides including the South side where of the new towers is proposed to be located. This
has created an Encroachment condition over existing sidewalkalready..A preliminary search of records
did not result in finding any exemptions or permits issued for such specific purpose (see photos). The new
design calls out for all Mansard roof to be taken out and replaced with a flat parapet all around (higher
heights at the said three "Towers"). The new Tower over side entry is an "architectura[ element added to
the top of entry door/ windows area and the only pan that projects outside property line. If also has a new
decorativemetal finished awning above the storefront window area which will span out another 2'-2"
from the face of new tower. Overall this new proposed encroachment is 8.'/"less than what is existing
already (13 1/2" For tower itself and 26" for the decorative awning") and it happens at about 9'-6" above
existing sidewalk which is the some height of existing eave of Mansard roof to be demolished.
In light of above, we feel that on encroachment permit should be considered for the new proposed
design as it significantly improves the aesthetic of existing structure while actually improving the existing
condition which hasbeen around for many years. Please refer to attached drawings and photos for
