A. Dennis Fox spoke regarding the following: State Fish & Wildlife concerns about
Nutria (South America Rodents) digging tunnels down canals/levee banks
along the state. 2) University of California Los Angeles is coming up with a
weather study regarding years of drought and ocean oscillation. 3) Workshops
in Sacramento, State Senate Water Committee Consultants, regarding
reservoir capacity, lack of snow melt, reservoirs filling up with dirt and flood
cushions. He recommends staff look into these issues.
5. REPORTS
A. Kern River & Isabella Reservoir Operations Report
John Ryan, Superintendent, reviewed the various graphs and stated that the
8 -gauge index indicates a basin wide average snow water equivalent of 10
inches of water content. There is very little snow above 11,000 feet and the
snow pack has melted. The Department of Water Resources State of
California B-120 report has the Kern River at 55% of normal which is estimated
to yield 250,000 acre feet for the Kern River interests; Mr. Ryan stated the yield
may end up being closer to 225,000 acre feet, Mr. Ryan's opinion is that this
year will end on a dryer note.

5. REPORTS continued
A. Art Chianello, stated we are at 55% water year and the City's water
entitlement supply this year is being distributed to three water treatment
plants, prior obligation demands, evaporation losses which occur within Lake
Isabela, and water for City facilities. For Board Information only, no action
taken,
B. Update on Water Usage in the City's Domestic Water Service Area
Jason Meadors, Water Resources Director, presented a brief report and
reviewed the Domestic Water Use Comparison and Metered Percent
Reduction graphs. Mr. Meadors stated On April 7, 2017 the Governor ended
the Drought State of Emergency for California's water purveyors. From May
2017 through April 2018 the City's Domestic Water Service Area had a
cumulative water conservation savings of approximately 9%. Also during this
time, the City's domestic water system increased in size by approximately 11 %.
The City is still recommending that conservation efforts continue due to
historically low groundwater levels and uncertainty of future water supplies,

C. Update on the TCP Mitigation Project
Jason Meadors, Water Resources Director, gave a report and stated on July
18, 2017, the State Water Board adopted a new maximum contaminant level
(MCL) for the groundwater contaminant 123 - Trichloropropane (TCP). The
new MCL went into effect January 1, 2018, The City turned off all TCP
affected wells. Last summer the City started the process of sampling and
equipping Group 1 (27 wells) with TCP treatment utilizing a contract with W.M.
Lyles. Currently some of the Group 1 (27 wells) are operating and water
demands are being met by existing unaffected wells; Group 1 wells where
construction is complete and are operating; and the surface water treatment
plants. Construction of all of the Group 1 (27 wells) should be completed by
the end of June, with one remaining Group 1 well to be completed in July.
Cal Water has done a good job operating the City's system. Surface water is
being used in our system to supplement offline wells, Eighty-four treatment
vessels have been installed to date and 60 of these vessels have been loaded
with the treatment media called granular activated carbon (GAC). Sampling
of the wells and vessels take place in a sequential order of construction
completion, Phase 2 of this project includes eight additional wells. The
scheduled completion date for the remaining eight wells is November 2018,
The project is going well and the City is complying with all drinking water
standards.

SUBJECT: Update on the Kern River North and South Levee Accreditation by the U.S.
Department of Homeland Security Federal Emergency Management Agency

BACKGROUND: The Kern River Levee District was formed in 1928 with the single responsibility to
operate and maintain a levee system along the Kern River through Bakersfield. On March 28,
2000 the Local Agency Formation Commission approved the merger of the Kern River Levee
District with the City of Bakersfield and establishment of a Subsidiary District. The attached map
shows the location of the river levees. The purpose of the Kern River levee system is to hold back
and contain high river flows and prevent flooding of developed areas. The Flood Map
Modernization program, a multi-year Presidential initiative funded by Congress from 2003 to 2008
called for the nation's flood maps to be improved and updated.
On April 23, 2007, the U.S. Department of Homeland Security notified the City of Bakersfield and
the County of Kern that FEMA was in the process of the Flood Map Modernization Program. The
existing Kern River levees, at the time of this notification, were accredited by FEMA for the 100
year flood event. During the Map Modernization process, FEMA would continue to accredit the
levee as a Provisionally Accredited Levee system (PAL).
It was the City's responsibility to provide data and analysis to FEMA so that once approved, FEMA
could permanently accredit the Kern River South levee for providing protection against the 100
year flood event. The portion of the South Levee that required re -accreditation was between
one mile west of Ming Avenue to Golden State Avenue.
Levee data, flood model analysis, and geotechnical reports were submitted to FEMA in July 2011.
The re -accreditation process for the South Levee was completed, as described in the attached
letter dated September 3, 2015 from FEMA. According to the letter, the Kern River South Levee
meets the minimum certification criteria outlined by the Code of Federal Regulations. FEMA
continued to accredit the levee system on the subsequent Flood Insurance Rate Map (FIRM)
update as providing protection from the 100 year flood. The accreditation allows insurance
companies to set reasonable rates and premiums for properties with the area protected by the
levee.

Back in March 2018, FEMA contacted the City of Bakersfield and wanted to meet with City staff
to provide an update on the FEMA Kern River Flood Hazard Study. The City and FEMA met and
discussed FEMA's analysis and mapping for non -accredited levee systems in the Bakersfield area.
The purpose of the meeting was to discuss updated flood hazard data and non -accredited levee
approach for the Flood Insurance Study (FIS) and the FIRMS for Bakersfield. FEMA wanted input
from the City on unique conditions of our levee system and wanted to collect any existing data
that will impact their analysis and mapping.
FEMA reviewed Bakersfield's certified levees and non -certified levees. FEMA determined that a
portion of the City maintained levee system located between Golden State Avenue and Manor
Street must be certified or mapped as a non -accredited levee to reflect the risk of being non-
accredited. The process to certify the levee systems from Golden State Avenue to Manor Street
would be the same process that the City went through with FEMA for the South Levee reach
located downstream.
Initial Modeling was done in August 2017 by FEMA. In March a levee Kickoff meeting was held
between FEMA, their consultants, Kern County, and the City. At that meeting the City learned
that it must certify the non -accredited levees before new preliminary FIRMS are issued so that
insurance rates in high risk areas (associated with the non -accredited levees) are not impacted.
The levees that are currently non -accredited were identified by FEMA when they obtained
updated survey data and ran a new hydraulic analysis model of the Kern River. According to
FEMA, due to construction of projects downstream the stretch of river channel between Golden
State Avenue and Manor Street, the river in that reach has less conveyance capacity that was
present when the City ran the last hydraulic mode. When the City modeled the river channel
and the levees along this reach of the river back in 2011, it was determined at that time that the
100 year flood elevation did not touch the base of the levee and therefore it was not required
that the levees be recertified. Now with the new model run by FEMA, it has been determined
that the 100 year flood will touch the levees and will need to be recertified so that the FIRMS are
not impacted. The City has reviewed FEMA's model and confirmed that it is correct.
FEMA has determined that the levees (North and South levees) from Golden State Avenue to
Manor Street are eligible for 'provisional accreditation' and, therefore, FEMA will be offering the
City of Bakersfield this option. This allows the City to apply the same accreditation approach that
was used to accredit the south levee in 2015. The Water Resources Department will use an existing
active agreement with consultant Meyer Civil Engineering for this levee recertification work.
Meyer Civil Engineering assisted with the successful accreditation process for the south levee in
2015.
2.20.030 Water board duties.
The city council for the city delegates to the water board for the city the
power to maintain and keep in repair all things reasonable or convenient for the
protection of the lands of the Kern River Levee District from overflow and for the
purpose of conserving or adding water to the sloughs and drains in the district. The
water board shall also, on behalf of the Kern River Levee District and the city
council, cooperate with the United States, the state of California, or any department
or agency of either, in order to accomplish any of the purposes of the district. In all
other matters, the water board will make recommendations to the city council for
action, and all powers not listed herein are reserved to the city council. (Ord. 3967

The above documentation and data have been reviewed, and based on receipt of this
information, the Kern River South Levees (Kern County Levee IDs 8, 9, 10, 13, 14, 15,
18, 99, 100, 200, and 201), meet the minimum certification criteria outlined in 44 CFR
65.10. Therefore, we plan to continue to accredit this levee system on the next Flood
Insurance Rate Map (FIRM) update as providing protection from the 1 -percent -annual -
chance (base) flood. The area protected from the base flood by this levee will be mapped
as a shaded Zone X, and a note will be placed warning of the flood risk that still exists.
Please be advised that levee systems, and the estimated level of protection provided by
these systems, can and do change with time. Future map updates may require the levee
system to be certified again at the time of update. Also, design, construction, operation,
and/or maintenance documents may be requested at any time. Deviations from the
documentation and data submitted to FEMA could result in the levee system no longer
being mapped as providing protection from the base flood on future FIRMS. If at any
point additional information is provided to FEMA that shows the levee system no longer
meets certification criteria as outlined in 44 CFR 65. 10, we will contact the levee owner
and community about the possibility of de -accrediting the levee system.
