NOTICE OF RIGHT TO APPEAL
Any person may appeal a decision of the Board of Zoning Adjustment. The appeal must
be filed in writing within 10 days from date of the Board's hearing with the City Council,
c/o City Clerk; 1501 Truxtun Avenue; Bakersfield, CA 93301. Appellants, except those
within the public notice area, must include a $334 non-refundable filing fee with the
appeal. If all appeals are withdrawn before the City Council's meeting, they will not hear
the item and the Board's decision will become final.
The City will not issue any permit, license or other approval for a use involved in an
application until after the appeal period has closed. If the City Clerk does not receive an
appeal within the 10-day period, the Board's decision will become final.

A. CONDITIONAL USE PERMITS

FILE NO. 02-0652 - SHANNON CAPUTO has requested a Conditional
Use Permit to allow retail sales of antiques and gifts in a C-O
(Professional and Administrative Office) zone district. A previous
conditional use permit was approved for the site in 1988 to allow retail
sales, but expired several years ago after a period of inactivity, located at
1108 H Street.
Staff Recommendation:

FILE NO. 02-0660 - VENTURE OUT has requested a Conditional Use
Permit to allow a recreational vehicle sales and service center within and
adjacent to an existing 102,492 square foot vacant building in a C-2
(Regional Commercial) zone district. The building was most recently
used as a retail home improvement store, located at 6801 Colony Street.

FILE NO. 02-0661 - SKARPHOL ASSOCIATES has requested a
Conditional Use Permit to allow a private club including a restaurant, bar,
and meeting room within an existing office building in a C-O
(Professional and Administrative Office) zone. The proposed private club
will be located on the 12th floor of the building, located at 5060 California
Avenue.

B. MODIFICATIONS

FILE NO. 02-0556 - HENRY G. CASTANEDA has requested a
Modification to allow a reduction in the front yard setback from 25 feet
(required to 7 feet (proposed) to accommodate construction of a pool and
to allow a six (6) foot high fence within the front yard in an R-1 (One
Family Dwelling) zone. The lot is irregularly shaped (triangular) which
limits the buildable area. The lot is located at 5103 Donaldo Street.

FILE NO. 02-0703 - SEAN ABAII has requested a Modification of the
building height to allow an apartment complex with three story apartment
buildings where two and a half stories is the maximum allowed in the R-3
(Limited Multiple-Family Dwelling) zone. The applicant plans to
construct an 80 unit apartment complex on the site, located at 500 R
Street.
