AN ORDINANCE REPEALING CHAPTER
14.16 OF THE BAKERSFIELD MUNICIPAL
CODE AND ADDING A NEW CHAPTER 14.16
RELATING TO SEWER USE IN THE
UNINCORPORATED AREA; AMENDING
SECTION 14.04.030 (E) RELATING TO WATER
SERVICE; AND REPEALING SECTIONS
14.04.030 (F) AND (G)
BE IT ORDAINED by the Council of the City of Bakersfield as follows:
SECTION 1.
Chapter 14.16 of the Bakersfield Municipal Code relating to sewer use by nonresidents
is hereby repealed.
SECTION 2.
A new Chapter 14.16 is hereby added to read as follows:
CHAPTER 14.16 SEWER SERVICE IN THE UNINCORPORATED AREA -
EXCEPTIONS

14.16.010 No sewer service - exceptions.
City sewer service shall not be extended outside the incorporated area of the City after
the effective date of this ordinance excepting intergovernmental sewer service contracts
approved by the City Council. Intergovernmental sewer service contracts shall comply with
state law.
14.16.020 Rates and charges.
Where an intergovernmental sewer service contract has been entered into, the annual
rate and charges for connection to a City sewer outside the City limits shall be composed of

the sum of a capacity and use charge which shall be established by either the service contract
terms or by a resolution adopted by the City Council.
14.16.030 Basis and purpose of rates and charges.
A. The rates and charges set in accordance with this chapter shall be set at a level
which will compensate the city for the expense incurred in furnishing sewer facilities,
equipment, supervision, and regulation of sewage disposal and the sewer farm, for property
owners outside the city limits of the city who have connected their property with the main sewer
system of the city, and said rates and charges as set by resolution or contract shall be a
reasonable fee for the privilege and the service.
B. Said rates and charges shall be based upon service to the property or
properties connected, and no combination of facilities served shall alter the rate to be charged
for each facility.
SECTION 3.
Section 14.04.030 (E) of the Bakersfield Municipal Code is hereby amended to read
as follows:
E. No application for a water connection to the city-owned system shall be
approved for an unincorporated area after the effective date of this ordinance.
SECTION 4.
Sections 14.04.030 (F) and (G) of the Bakersfield Municipal Code are hereby
repealed.
SECTION $,
This Ordinance shall be posted in accordance with the provisions of the Bakersfield
Municipal Code and shall become effective thirty (30) days from and after the date of its
passage.
