AN ORDINANCE OF THE COUNCIL OF THE CITY
OF BAKERSFIELD ADDING CHAPTER 15.76 TO
TITLE 15 OF THE BAKERSFIELD MUNICIPAL CODE
RELATING TO IMPROVED ACCESS TO PROPERTY.
BE IT ORDAINED by the Council of the City of Bakersfield
as follows:
SECTION 1.
Chapter 15.76 is hereby added to Title 15 of the
Bakersfield Municipal Code to read as follows:

Purpose.

15.76.010 Purpose.
The purpose of this chapter is to insure that vehicular
access to private property from public or private streets is sur-
faced in such manner so as to prevent dust generated by vehicular
use of such access from becoming a bother or nuisance to adjacent
properties, and to provide all-weather access for fire apparatus
and other service equipment.
15.76.020 Improved access required.
Each driveway or other vehicular access from any public
or private street to any structure or any parking area shall be
paved, over three inches of base, with asphalic concrete, or
other street surfacing material approved by the building direc-
tor. Such other surfacing material shall be not less than two
inches in thickness. Such access shall be designed to drain in
conformance with the drainage plan for the site.
15.76.030 Notice to improve access.
A. Upon determination that any vehicular access to any
structure or parking area does not meet the requirements of this
Chapter, the building director shall, by written notice mailed,
postage prepaid, to the owner or owners of the parcel, advise
the same of the nature of the deficiency and notify the same that
unless the violation of this section is corrected within thirty
calendar days, action pursuant to Section 15.04.170 of this title
shall be commenced. Abandonment of any such access, to the sat-
isfaction of the building director, shall be deemed a correction
of the deficiency provided other legal access meeting the
requirements of this section is available.
15.76.040 Modification of requirements.
Whenever, because of distance between the unimproved or
insufficiently improved access and adjoining property or other
factors deemed good and sufficient by the building director,
strict compliance with the requirements of this chapter are
determined by the building director to be inappropriate, he may
modify or waive such requirements consistent with accomplishing
the purpose of this chapter as set forth in Section 15.76.010.
SECTION 2.
This ordinance shall be posted in accordance with the
City charter provisions and shall become effective thirty (30)
days from and after the date of its passage.

lar meeting thereof held on January 14, 1987
