Applicant agrees that if this application is granted, applicant shall indemnify, defend and hold harmless the City, its
officers agents and employees against any and all liability, claims, actions, causes of action or demands, whatsoever
against them, or any of them, before administrative, quaslyudicial, orjudkial tribunals of any kind whatsoever, arising out
-of, connected with. or caused by applicant's placement, erection, use (by applicant or any other person or entity) or
maintenance of said encroachment. The applicant further agrees to maintain the aforesaid encroachment during the life
of said encroachment or until such time that this permit is revoked.
Applicant further agrees that upon the expiration of the permit for which this application is made, if granted or upon the
property or right of way where the same is located, and restored said public property or right of way to the condition as
nearly as that in which it was before the placing, erection, maintenance or existence of said encroachment.
Applicant further agrees to obtain and keep all liability insurance required by the City Engineer in full force and effect for
however long the encroachment remains. Applicant shall furnish the City Risk Manager with a Certificate of Insurance
evidencing sufficient coverage for bodily injury or property damage liability or both and required endorsements evidenc-
ing the insurance required. The type(s) and amount(s) of insurance coverage is:

LENDER'S LOSS PAYABLE ENDORSEMENT
I. Loss m damage, fully, underthls policy, Shall be paid to the Payee named in the Declarations ofdtis policy, its successors and assigns',
hereinafter referred to as'the Leudet, in whatever form or capacity its interests may appear and whether said interest be vested in said Lender in i6
individual or in its disclosed or undisclosed fiduciary or repreameabve capacity, or otherwise, ar, close in a nominee or trustee oflead Lender.
2. The insmmnw under this policy, or any rider nr endorsement attached Imucle. as to the interest only of the Lender, its successors and assigns, shall
not be invalidated nor suspended (a) by any error, omission, or change respecting the ownership, description, possession, m location ofthe side old of
the insurance or the inmreatlhercia, or the title thereto; (b) by the commencement of foreclosure. proceedings or Ne giving of notice ofsale of any of
the property covered by this policy by virtue of any mortgage or trust deed, (c) by any breach of warranty, act) omission, neglect, or non-compliance'
with any ofthc provisions of this policy, including any and all riders now or hereafter attached thereto, by the named insured, the borrower,
mortgagor, trunor, vendee, owner, tenant, warehousemen, custodian, occupant, or by the agent ofeither or my of Nem or by the happening of any
event permitted by them ar either of them, or their agents, or which they failed to prevent, whether occurring before or after the lunchtime of this

insured to pay such premium shall pay m cause to be paid the premium due Within ten {10) days following receipt of the Company's demand in
writing therefor. If the Lender shall decline to pay said premium or additional premium, the rigitu ofthe Leader under this Lender's Loss Payable
Endorsement shall not he terminated before ten (10) days id :r receipt lifted written notice by the Lender.
4. Whenever this Company shall pay to the i.ender any sum for loss or damage under this policy and shall claim that us to the insured no liability
therefor exists, this Company, of its option, may pay to Ne Lender the whale principal sum mid interest and other indebtedness due or to became due

reduction in the rate charged or has received extensity of the coverage to include hazards other than Bre and compliance with such Contribution

7. Tbis policy shall remain in full force and effect as to the interest of the Leader for a period of len (10) days atter its exph don unless an
acceptable policy in renewal thereof with loss thereunder payable to the Lender in accordance with the leans of this Leader's Loss Payable

S. Should legal title to and beneficial ownership of any Of the property covered under this policy become vested in the fender or its agents, insurance
under this policy shall continue for Ne term thereof for the benc4t of the Lender that, in such evens, any Privileges granted by this Lenders Loss
Payable Endorsement which are not also granted the insured under theterms and conditions of this policy and/or under other riders or endorsements
attached thereto shal l nor apply to the insurance hereunder as respects such properly.
9. All notices herein provided to be given by the Company to the Leader in connection with this policy and this Leader's Loss Payable Endorsemem
shall be mailed to or delivered to the tender m its office or branch described in the Declarations of the policy.
