LaRochelle, Engineering Services Manager DATE: February 10, 1997 SUBJECT: Encroachment Permit Application for 215 Manzanillo Drive Bobby & Dana Gaines Installation of brick fence behind sidwalk in side yard . 3ZZ- 'r>A -5 A % Engineering and Traffic staff have reviewed the attached encroachment permit to allow the installation of a brick fence behind sidwalk in side yard. The site is a single fainhy residence on the corner of Manzanillo and Yucatan. The fence must be no higher than three feet within the 60' line of sight triangle, as shown on the attached sketch. The remainder of the fence may be six feet tall, as measured from the highest side. The applicant has provided proof of appropriate insurance coverage to the Building Department representative, and has provided signatures of most of the immediate neighbors stating that they have no objection to the proposed construction. The property owner was unabe to obtain a signature from the owners of 14405 Yucatan Avenue, who apparently oppose the fence construction. Period of time for which the encroachment is to be maintained: INDEFINITE Applicant agrees that if this application is 'granted, applicant will idemnify, defend and hold harmless City, its officers, agents, and employees against any and all liability, claims, actions, causes of action or demands, whatsoever against them, or any of them, before administrative, quasi - judicial or judicial tribunals of any kind whatsoever, arising out of, connected with or caused by applicant's placement, erection, use (by applicant or any other person or entity) or maintenance of said encroachment.
