Bergam, Civil Engineer III, Traffic Operations '�ZAA SUBJECT: Encroachment Permit Application for Tapas 1800 Chester Avenue Four Foot High Wrought Iron Fence 6' From Curb Upon review of the referenced application, City of Bakersfield Standard T -7 (attached), the Municipal Code 17.08.175, and the Chester Avenue Streetscape plans we have determined that construction of a permanent fence would obstruct public use of the sidewalk area, therefor we recommend denial of the request for a permanent fence. We recommend approval of the encroachment to allow outside seating during business hours only along the 181 Street frontage keeping the 6' sidewalk area (measured from the back of curb) clear for pedestrians. Tables and chairs should be removed during non - business hours and the public sidewalk kept clear during non - business hours. The request for seating along Chester Avenue should be denied until construction of the streetscape is complete, at which time, a determination of usable pedestrian space could be re- evaluated. Any person, firm or corporation, whose property encroaches in any manner upon, over or under any property of the city, or any street, avenue, lane, alley, sidewalk, court, place, public way, property or rights -of -way, now open or dedicated or which may hereafter be opened or dedicated to public use within the city, who does not have a valid permit from the city engineer for the placing, erection and/or maintenance of such encroachment shall remove the same after written notice by the city engineer demanding such removal. B. Notice of such removal shall be by registered mail, address to the post office address of the owner or occupant of the premises where the encroachment exits, or by personal service of such notice upon the owner or occupant, by a person authorized by the city engineer to deliver such notice. C. The time required for the removal of said encroachment shall be specified in the notice by the city engineer. D. If any encroachment as defined in this chapter is not removed as required by this chapter the city engineer may cause the same to be removed and charge the expense thereof, including, but not limited to, any administrative expense, to the holder of the encroachment permit at the time the removal was required.
