IF, -Q0 A RESOLUTION DETERMINING THAT AN UPGRADE TO THE ICE CHILLER AT THE RABOBANK ARENA CANNOT BE REASONABLY OBTAINED THROUGH THE USUAL BIDDING PROCEDURES AND AUTHORIZING THE FINANCE DIRECTOR TO DISPENSE WITH BIDDING THEREFOR AND CONTRACT WITH CIMCO REFRIGERATION, INCORPORATED TO UPGRADE SYSTEM NOTTO EXCEED $1,001,500. WHEREAS, the City must upgrade ice chiller at the Rabobank Arena which is the original equipment when the facility opened in 1998; and WHEREAS, the existing ice chiller had emergency repairs completed in 2014 which extended the life of the chiller an additional three to seven years; and WHEREAS, the Environmental Protection Agency (EPA) regulations have restricted the use and availability of R22 refrigerant with a complete phase out of new R22 systems and refrigerant by 2020; and WHEREAS, R22 refrigerant is estimated to be three times more expensive (removing all the R22 in the existing system and refilling it would cost approximately $100,000) and may not be available in 2020; and WHEREAS, restricted contractor availability due to the necessity for all ice chillers across the North American continent being converted from R22 to NH3 systems by the year 2020; and WHEREAS, any delay in approving the agreement will cause the work to be re -scheduled to 2020 or beyond due to the volume of work being scheduled; and WHEREAS, materials cost for the project may increase and materials availability will be affected if the start date for the upgrade is delayed orextended; and WHEREAS, CIMCO Refrigeration, Incorporated, can guarantee a system upgrade by the summer of 2019 if the agreement is approved August 15,2018; and NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Bakersfield as follows: 1. The work, supplies, equipment or materials can only be reasonably obtained from one vendor because of restricted availability of such work, supplies, equipment, materials, or time frame for completion. 3. The Finance Director is authorized to dispense with bidding in accordance with Section 3.20.060 of the Bakersfield Municipal Code. 4.
