HomeMy WebLinkAboutORD NO 3096ORDINANCE NO. 3096 NEW SERIES AN ORDINANCE OF THE COUNCIL OF THE CITY OF BAKERSFIELD AMENDING TITLE SEVENTEEN OF THE BAKERSFIELD MUNICIPAL CODE BY CHANGING THE LAND USE ZONING OF THOSE CERTAIN PROPERTIES IN THE CITY OF BAKERSFIELD LOCATED IN THE JEFFERSON SCHOOL/ALTA VIS?A AREA AND THE NILES/MONTEREY CORRIDOR AREA. WHEREAS, in accordance with the procedure set forth in the provisions of Title 17 of the Municipal Code of the City of Bakersfield, the Planning Commission has held a public hearing on a petition to change the land use zoning of certain properties in the City of Bakersfield located in the Jefferson School/Alta Vista area and the Niles/Monterey corridor area; and WHEREAS, the Planning Commission, as a result of said hearing, did make several general and specific findings of fact which warranted a negative declaration of environmental impact and a change of zoning of the subject properties from an R-3 and R-2 to R-1 and R-4 and R-3 to C-l, and the Council has considered said findings and all appear to be true and correct; and WHEREAS, there appears to be no substantial detrimental environmental impact which could result from the proposed pro- ject; and WHEREAS, the City Council has determined after due con- sideration of said petition and the recommendations of the Planning Commission herein on file, together with the reasons advanced at the hearing for a change of zoning of said proper- ties, that a zoning change should be authorized; and WHEREAS, the City Council has determined and found that the proposed zoning is consistent with the General Plan of the City of Bakersfield and with the Baker Street Corridor Specific Plan. NOWt THEREFORE, BE IT ORDAINED by the Council of the City of Bakersfield as follows: 1. All of the foregoing recitals are hereby found to be true and correct. 2. An environmental assessment was made of the project, and a Negative Declaration was adopted by the Planning Commission after a public hearing thereon, and this Council hereby approves and adopts the Negative Declaration. 3. Section 17.06.020 (Zoning Map) of the Municipal Code of the City of Bakersfield be and the same is hereby amended by changing the land use zoning of certain Droperties in said City, the boundaries of which properties are shown on the map hereto attached and made a part hereof, as follows: AREA NO. 1 - JEFFERSON SCHOOL/ALTA VISTA AREA: Two (2) parcels of land situated in the South half of Section 20, T. 29 S., R. 28 E., ~.D.B.&M., City of Bakersfield, County of Kern, State of California, more particularly described as follows: PARCEL 1 Beginning at the point of intersection of the South line of Bernard Street and the East line of Alta Vista Drive, also being the northwest corner of Block 7 of "Alta Vista Tract"; THENCE East along said South street line to intersect the South line of Grace Street; THENCE southeasterly, along said South street line, to intersect the center line of that 15 foot wide (North-South) alley between Kern Street and Baker Street also being on the North line of ~1ock 4 of "Bernard Addition Tract"; THENCE southwesterly, along said alley center line, through Blocks 4, 10, 17, 33, and 40 of said tract, to intersect the northwesterly right of way line of State Freeway 178; THENCE southwesterly on and along said right of way line to intersect the East line of Alta Vista Drive, also being a point on the West line of Block 2 of said "Alta Vista Tract"; THENCE northeasterly, along said East street line and adjacent to Blocks 2, 3, 4, 5, 7, 20 and 30 of said tract to the point of beginning. PARCEL 2 Beginning at the point of intersection of the South line of Bernard Street and the West line of King Street also being the extended northeast corner of Block 3 of "Bernard Addition Tract"; THENCE southwesterly, along said West street line and adjacent to Blocks 3, 11, 16 and 34 of said tract to the southeast corner of said Block 34; THENCE southwesterly to the point of intersection of the North line of Block 39 of said tract and the northwest right of way line of State Freeway 178; THENCE southwesterly on and along said right of way line to intersect the center line of that 15 foot wide (North-South) alley in Block 39 of said tract; THENCE northeasterly, along said alley center line~ through Blocks 11, 16, 34 and 39 and northeasterly projection through Block 3 of said tract to intersect the south line of Bernard Street; THENCE East, along said South street line to the point of beginning. AREA NO. 2 - NILES/MONTEREY CORRIDOR AREA: A parcel of land situated in Sections 28 and 29 of T. 29 S., R. 28 E., M.D.B.&M., City of Bakersfield, County of Kern, State of California, more particularly described as follows: Beginning at the point of intersection of the East line of Beale Avenue and the center line of that 20 foot wide (East-West) alley 1/2 block North of Monterey Street, also being on the West line of Block 27 of "Kern Division Tract"; THENCE southeasterly along said alley center line, through Blocks 27, 28, 29, 30, 31, 32 and 167 of said tract to intersect the West line of Williams Street; THENCE southwesterly to along said West street line to intersect the center line of that 20 foot wide (East-West) alley 1/2 block South of Monterey Street, also being on the East line of Block 170; - 3 - THENCE northwesterly, along said alley center line, through Blocks 33, 34, 35, 36, 37, 38 and 170 to intersect the East line of Beale Avenue; THENCE northeasterly along said East street line, crossing Monterey Street, to the point of beginning. SECTION 2. This ordinance shall be posted in accordance charter provisions and shall become effective thirty and after the date of its passage. with the City (30) days from .......... o0o ..........
