Minutes of a recessed meeting of the Council of the City
of Bakersfield, California, held in the Council Chambers of City
Hall at 12:10 P.M., August 30, 1976.
The meeting was called fo order by Vice-Mayor Bleecker,
followed by the Pledge of Allegiance.
The City Clerk called the roll as follows:
Present: Councilmen Christensen, Medders, Rogers, Strong seated
at 12:20 P.M.), Barton, Bleecker
Absent: Mayor Hart. Councilman Sceales.
Correspondence.
Upon a motion by Councilman Medders, communications from
William J. Brady, 918 Truxtun Avenue, and Francis Marr, 1030 - 17th
Street, protesting the proposed expansion of the Downtown Bakers-
field Redevelopment Project area, were received and ordered placed
on file.
Upon a motion by Councilman Rogers, communication and
resolution from the City o£ Shafter requesting the City of Bakers-
field's support in their opposition to the Wasco Nuclear Power
Plant, was received and ordered placed on file.
Reports.
Councilman Rogers, Chairman of the Water and City Growth
Committee, read Report No. 12-76 regarding Financial Consultants,
as follows:
The City's purchase of Kern River water rights
from Tenneco West has been conditioned by
Tenneco to being completed on or before
December 31, 1976. Some of the steps necessary
to the financing of the purchase must now be
started if the City is to maintain all of its
financing options. The City's financial con-
sultant has informed us that in order to meet
the deadlines set by the agreement, some major
work relating to the gathering of financial
and economic data must begin today. Some costs
will therefore be incurred at this time. The
City's financial consulting firm of L. F.
Rothschild Co. is preparing an amendment to
their contract with the City which will show
those costs to total up to $115,000 if the
purchase is financed with a general obligation
bond issue and there could possibly be an

additional $55,000 in costs if the City pursues
its option to finance the purchase through the
issuance of Water Facilities Corporation revenue
bonds and lease revenue bonds.
If the City finances the purchase through the
issuance of general obligation bonds, the City
will recover up to $115,000 of the costs from
the bond proceeds. The additional cost will
be recovered if the City finances the purchase
through the Water Facilities Corporation.
The Committee feels that the purchase of the
Kern River water rights for the citizens of
Bakersfield is so important to the City that
even though the amendment to the contract
relating to the new general obligation bond
and other financing options has not been
received, the City should take the risk of
authorizing the financial consultants to pro-
ceed today with whatever steps may be necessary
to meet any and all deadlines necessary to
maintain all the City's present financing
options.
Motion to accept report and authorize the
financial consultant to proceed with whatever
steps may be necessary to meet any deadlines
necessary to maintain all the City's present
financing options.
Upon a motion by Councilman Rogers, Report No. 12-76 of
the Water and City Growth Committee regarding Financial Consultants,
was accepted and the Financial Consultant was authorized to pro-
ceed with whatever steps that may be necessary to meet any dead-
lines necessary to maintain all the City's present financing
options.
Consent Calendar.
The following item was listed on the Consent Calendar:
(a) Allowance of Claims Nos. 745 to 807,
inclusive, in the amount of $81,856.10.
Upon a motion by Councilman Christensen, Item (a) of the
Consent Calendar, was adopted by the following roll call vote:

Deferred Business.
Adoption of Ordinance No. 2291 New
Series of the City Council of the
City of Bakersfield approving and
adopting Amendments to the Amended
Redevelopment Plan for the Downtown
Bakersfield Redevelopment Project.
Councilman Medders made a motion to adopt an Ordinance
of the City Council of the City of Bakersfield approving and
adopting Amendments to the Amended Redevelopment Plan for the
Downtown Bakersfield Redevelopment Project.
Community Development Director Foster reported on the
meetings that have been held with the persons who were objecting
to the expansion of the Downtown Bakersfield Redevelopment Project
area and as of this morning only three property owners are still
in opposition.
Councilman Strong stated that he has strong reservations
about the City taking the steps necessary to go forward with this
development and questioned the urgency of adopting the Ordinance
today.

stated that the developer of this project cannot go any
a commitment from the City and
Redevelopment Agency.
Councilman

that eight changed their minds once it was understood that a fair
price would be given for their property.
During discussion Councilman Strong stated, for the
record, that he is definitely not against the project because it
is a progressive step in the right direction; but, inasmuch as the
City has

Upon a motion by Councilman Rogers, the staff and
consultants were instructed to make a continued effort, in every
possible way, to satisfy the three property owners who are in
opposition and all other property owners in the area with regard
to the project and use of eminent domain and purchase of their
properties, by the following roll call vote:
Ayes: Councilmen Christensen, Medders, Rogers, Strong, Barton,
Bleecker

Absent: Councilman Sceales
Upon a motion by Councilman Medders, Ordinance No. 2291
New Series of the City Council of the City of Bakersfield approving
and adopting Amendments to the Amended Redevelopment Plan for the
Downtown Bakersfield Redevelopment Project, to be effective thirty
days from today, was adopted by the following roll call vote:
Councilmen Christensen, Medders, Rogers, Strong, Barton,
Bleecker

New Business.
Adoption of Resolution No. 67-76 of
the Council of the City of Bakers-
field regarding its intent to delete
area from the Downtown Bakersfield
Redevelopment Project Area under
certain circumstances.
The Redevelopment Agency at the Joint Public Hearing
held on August 19, 1976 passed a Resolution requesting that the
City Council adopt a Resolution, to be worded by the Agency's
Special Counsel, which would begin the process of deleting the
new boundaries if the hotel/office building complex did not
materialize within one year.

Upon a motion by Councilman Medders, Resolution No. 67-76
of the Council of the City of Bakersfield regarding its intent to
delete area from the Downtown Bakersfield Redevelopment Project
Area under certain circumstances, was adopted by the following
roll call vote:
Ayes: Councilmen Christensen, Medders, Rogers, Strong, Barton,
Bleecker
Noes: None
Absent: Councilman Sceales
Upon a motion by Councilman Strong, the staff was instructed
to update the Council on their meetings with the property owners
who object to the amendments to the Downtown Bakersfield Redevelop-
ment Project area at each Council Meeting prior to the effective
date of the Ordinance.
Adjournment.
There being no further business to come before the
Council, upon a motion by Councilman Christensen, the meetlng was
adjourned at 1:20 P. M.
