respect to-'Parcel Map Waivers arid Lot Line Adjustments and
acting herein on behalf of the City of Bakersfield, hereby
certifies that the Parcel Map Waiver for the hereinafter-
described parcel of land complies with the provisions of the
Subdivision Map Act of the State of California and Chapter 16
of the City of Bakersfield Municipal Code regulating
divisions of land.
Said parcel of land, being situated in the City of Bakersfield,

THIS DECLARATION IS MADE ON MAY 2 2 , 1987, BY COLSON AND COLSON
CONSTRUCTION, AN OREGON GENERAL PARTNERSHIP AND PARK HILL CONDO
ASSOCIATION, A PROPERTY OWNERS ASSOCIATION.
PREAMBLE
A. COLSON AND COLSON CONSTRUCTION, GRANTORS UNDER THIS
AGREEMENT, ARE THE OWNERS OF THAT CERTAIN REAL PROPERTY
LOCATED IN THE CITY OF BAKERSFIELD, COUNTY OF KERN,
CALIFORNIA, DESCRIBED AS FOLLOWS:
PARCELS 1 AND 2 OF PARCEL MAP 5615 IN THE CITY OF
BAKERSFIELD, COUNTY OF KERN, STATE OF CALIFORNIA, AS PER MAP
RECORDED FEBRUARY 27, 1980 IN BOOK 24, PAGE 150 OF PARCEL
MAPS, IN THE OFFICE OF THE COUNTY RECORDER OF SAID COUNTY.
EXCEPTING THEREFROM THAT PORTION LYING WITHIN TRACT 4352 —A.

ACCESS FOR MAINTENANCE AND FIRE PROTECTION
COLSON AND COLSON CONSTRUCTION AND PARK HILL CONDO ASSOCIATION
HEREBY GRANT TO EACH OTHER REASONABLE ACCESS OVER THEIR
PROPERTIES FOR THE SOLE PURPOSE OF MAINTENANCE AND REPAIRS TO
LANDSCAPING; CONCRETE BLOCK WALL AND DRAINAGE GUTTERS BETWEEN THE
PROPERTIES, THE FIRE PROTECTION GATES ALONG SAID BLOCK WALL AND
SEWER FACILITIES WHICH ARE USED BY BOTH PROPERTIES. PRIOR TO
ACCESS FOR MAINTENANCE OR REPAIRS APPROPRIATE PARTIES MUST NOTIFY
EACH OTHER OF THEIR SPECIFIC NEED FOR ACCESS AND LOCATION FOR
SAID ACCESS. EMERGENCY ACCESS WILL BE REPORTED TO THE
APPROPRIATE PARTIES IN A TIMELY MANNER.

IMPROVEMENTS
1. IMPROVEMENT ALONG PROPERTY LINE
A) COLSON AND COLSON CONSTRUCTION AGREES TO MAKE ALL
IMPROVEMENTS ALONG THE COMMON PROPERTY LINE, UPON CITY
OF BAKERSFIELD APPROVALS AS SHOWN ON EXHIBIT "A"
ATTACHED. THEY ALSO AGREE TO REPAIR OR REPLACE ALL
EXISTING IMPROVEMENTS DAMAGED, DUE TO CONSTRUCTION OF
SAID IMPROVEMENTS, TO THE SATISFACTION OF PARK HILL
CONDO ASSOCIATION. THEY ALSO AGREE TO KEEP PARK HILL
.CONDO ASSOCIATION NOTIFIED OF ALL CONSTRUCTION
SCHEDULES AND ACCESS REQUIREMENTS PRIOR TO ANY
CONSTRUCTION.
B) PARK HILL CONDO ASSOCIATION AGREES TO ALLOW COLSON AND
COLSON CONSTRUCTION ACCESS TO INSTALL, MAINTAIN AND
REPAIR ALL IMPROVEMENTS PROPOSED ALONG THE COMMON
PROPERTY LINE AS SHOWN ON EXHIBIT "A ".
2. SEWER IMPROVEMENTS
A) COLSON AND COLSON CONSTRUCTION AGREES TO ENLARGE THE
CAPACITY OF THE EXISTING SEWER LIFT STATION NOW SERVING
PARK HILL CONDO ASSOCIATION TO THE SATISFACTION OF THE
CITY OF BAKERSFIELD TO ACCEPT ADDITIONAL SEWAGE FROM
ITS- DEVELOPMENT. UPON FINAL REQUIRED
ALTERATIONS TO THE LIFT STATION THE CITY OF BAKERSFIELD
WILL, ACCEPT AND MAINTAIN THE LIFT STATION UNDER AN
EXISTING MAINTENANCE AGREEMENT ON FILE AT THE CITY OF
BAKERSFIELD.
B) COLSON AND COLSON CONSTRUCTION AGREES TO NOTIFY AND
MAKE ARRANGEMENTS WITH PARK HILL CONDO ASSOCIATION 48
HOURS PRIOR TO ANY SHUT DOWN OF EXISTING SEWER SERVICES
REQUIRED TO ALTER THE LIFT STATION AND TIE IN PROPOSED
SEWER MAINS TO THE EXISTING SEWER MAIN.
C) PARK HILL CONDO ASSOCIATION AGREES TO ALLOW COLSON AND
COLSON REASONABLE SEWER SHUT DOWN TIME TO COMPLY WITH
CONSTRUCTION REQUIREMENTS TO ALTER THE EXISTING LIFT
STATIONS AND TIE IN PROPOSED SEWER LINES. IT IS AGREED
THAT SEWER SHUT DOWN TIME IS NECESSARY AND WILL ONLY BE
DONE AT TIMES AGREED ON BY BOTH PARK HILL CONDO
ASSOCIATION AND COLSON AND COLSON CONSTRUCTION.
D) COLSON AND COLSON CONSTRUCTION AGREES TO' ASSUME ALL
CONSTRUCTION COSTS IN REGARDS TO ALTERING THE EXISTING
SEWER LIFT STATION AND CONSTRUCTION OF NECESSARY SEWER
FACILITIES WITHIN THEIR PROPERTY.

E) COLSON AND COLSON CONSTRUCTION AGREES IF ANY SEWER
STOPPAGE, QUE TO NEGLECT OF MAINTENANCE OF THE SEWER
MAINS WITHIN THEIR PROPERTY (EXCEPT THE LIFT STATION
AND FORCE SEWER MAIN WHICH IS MAINTAINED BY THE CITY OF
BAKERSFIELD) WHICH CAUSES ANY DAMAGES TO PARK HILL
CONDO ASSOCIATION OWNERS, COLSON AND COLSON
CONSTRUCTION WILL BE LIABLE FOR SAID DAMAGES.
3. STORM DRAIN IMPROVEMENTS
A) COLSON AND COLSON CONSTRUCTION AGREES TO CONSTRUCT AN
18" STORM DRAIN TO THE WEST OF THEIR PROPERTY TO ACCEPT
STORM WATERS GENERATED BY COLSON AND COLSON
CONSTRUCTION'S PROPERTY AND PARK HILL CONDO
ASSOCIATIONS PROPERTY. SAID STORM DRAIN AND
APPURTENANT FACILITIES WILL BE CONSTRUCTED AT NO COST
TO PARK HILL CONDO ASSOCIATION AND WILL BE MAINTAINED
BY COLSON AND COLSON CONSTRUCTION.
IV
MAINTENANCE
1. COLSON AND COLSON CONSTRUCTION AGREES TO MAINTAIN AND REPAIR
ALL THE SITE IMPROVEMENTS WITHIN THEIR PROPERTY AND THE 6
FOOT SLUMP STONE BLOCK WALL BETWEEN THE PROPERTIES, THE TWO
EMERGENCY FIRE GATES, THE DRAINAGE GUTTER ALONG THE EAST
FACE OF SAID BLOCK WALL AND THE SEWER AND DRAINAGE
FACILITIES WHICH ARE APPURTENANT TO THEIR PROPERTY UPON ITS
DEVELOPMENT AS SHOWN ON EXHIBIT "A ".
2. PARK HILL CONDO ASSOCIATION AGREES TO MAINTAIN ALL OF ITS
OWN EXISTING SITE IMPROVEMENTS AND APPURTENANT SEWER AND
DRAINAGE FACILITIES THAT NOW EXIST WITHIN ITS OWN PROPERTY.

DURATION
THIS DECLARATION SHALL CONTINUE IN FULL FORCE FOR A TERM OF FIFTY
(50) YEARS FROM THE DATE HEREOF, AFTER WHICH TIME THE SAME SHALL
BE AUTOMATICALLY EXTENDED FOR SUCCESSIVE PERIODS OF TEN (10)
YEARS, UNLESS A DECLARATION OF TERMINATION IS RECORDED.
