ENGINEERING FROM: JENNIE ENG, PLANNIN SUBJECT: LANDSCAPE STRIP LOCATED ON NORTH SIDE OF MING AVE BETWEEN ARVIN- EDISON CANAL AND HAGGIN OAKS BLVD. (MAINTENANCE DISTRICT NO. 7 ) (RELATED TO SPR 1272 -C SUBMITTED BY MARTIN- MCINTOSH) This memo is in response to your inquiry regarding the above item. This location is within the boundaries of existing Maintenance District No. 7. It is to have a landscape strip of a width to be determined. The 20 -foot wide landscape setback indicated on the grading plan is acceptable. However,,the City does not usually maintain landscaping on commercial or office property. I recommend the following conditions to clarify and assure adequate installation and maintenance of the landscaping. 1. Prior to issuance of any building permit, property owner shall submit for Planning Commission consideration and approval a street scape concept plan and method of maintenance for the North side of Ming Ave. between Arvin - Edison Canal and Forum Way. The concept design shall be consistent with existing landscaping themes. (You may consult with the City Parks Dept. and Public Works Dept regarding landscape design and choice of plant materials.) 2. Property owner shall dedicate to the City for a 20 -foot wide landscap- ing easement along Ming Ave. Each property owner shall submit in writing an agreement to install and maintain the landscaped area in accordance with plans approved by the City. 3. Each property owner is responsible for maintenance of the Ming Ave. frontage landscaped area adjacent to their property. If the property owner fails to maintain the landscape strip according to City standards, the property owner shall be notified by the City that the landscaping would be maintained through assessments obtained by Maintenance District No. 7. The property owner shall be assessed their proportionate cost of maintaining the landscaping within the easement adjacent to their property. While the property owner main- tains the 20 -foot landscape area, there would be no assessment for the maintenance of the 20 -foot landscape area. If the property owner fails to maintain the 20 -foot landscape area, the City would levy an assessment through Maintenance District No. 7. 4. Each property owner shall be charged their proportionate share of maintenance cost for the landscaped median islands within Maintenance District No. 7. i December 8, 1988 Memo - Harry Afshar Page 2 5. Separate electrical and water meters and irrigation control clocks will be required for all on- site /off -site landscaped areas. The meters for off -site landscaping shall.be located within the street right-of-way. 6. All landscape and irrigation plans shall be approved by the City Parks Superintendent and the City Engineer, prior to installation. 7. Prior to recordation of a final subdivision map or issuance of the first building permit, the property owner shall record CC &Rs to reflect the above conditions, including landscape maintenance and indicating the property is within the boundaries of existing Maintenance District No. 7.
