AN ORDINANCE OF THE COUNCIL OF THE CITY OF
BAKERSFIELb ADDING SECTION 2.24.023 TO THE
BAKERSFIELD MUNICIPAL CODE RELATING TO THE
APPROVAL OF SALE OR LEASE OF PROPERTY.
WHEREAS, Section 33433 of the Health and Safety Code
requires approval by the legislative body of property to be sold
or lease by the Central District Development Agency which was
acquired in whole or in part, directly or indirectly with tax
increment funds; and
WHEREAS, Section 33433 of the Health and Safety Code
provides that the legislative body made by ordinance require two-
thirds vote approval for such sale or lease; and
WHEREAS, City Council of the City of Bakersfield desires
to implement the provisions of Section 33433 of the Health and
Safety Code.
NOW, THEREFORE, BE IT ORDAINED by the Council of the City
of Bakersfield as follows:
2.24.023 Approval of Sale or Lease of Property.
Before any property of the Agency acquired in whole or in
part, directly or indirectly, with tax increment monies is sold or
leased for development pursuant to the redevelopment plan, such
sale or lease shall first be approved by a two-thirds vote of the
City Council after public hearing and pursuant to the provisions
of the California Health and Safety Code Section 33433.

SECTION 2.
This ordinance shall be posted in accordance with the
charter provisions and shall become effective thirty (30)
from and after the date of its passage.

I HEREBY CERTIFY that the foregoing Ordinance was passed
and adopted by the Council of the City of Bakersfield at a regular
meeting thereof held on May 20, 1987 _ , by the
