Act lr 9-M A RESOLUTION DISPENSING WITH BIDDING PROCEDURES DUE TO LACK OF AVAILABLE OUTLETS FOR RECYCLED WOOD CHIPS FOR THE CITY'S MT.VERNON AVENUE RECYCLING FACILITY, AND AUTHORIZING LIBERTY COMPOSTING, INC. TO HAUL WOOD CHIPS FROM THE FACILITY NOT TO EXCEED TWO HUNDRED FORTY THOUSAND DOLLARS ($240,000). WHEREAS, In the wake of the closure of the Delano Energy Plant in December 2015, the City's Mount Vernon Avenue Recycling Facility (Facility) has been continuously in need of new outlets for bulk quantities of recycled wood chips; and WHEREAS, the City entered Agreement No. 18-051 with K&I Services, Inc. (K&I)to haul recycled wood chips to new outlets as such outlets are found; and WHEREAS, the City found Liberty Composting, Inc. in Lost Hills, California (Liberty) to be an outlet for recycled wood chips; and WHEREAS, the City began utilizing K&I to transport recycled wood chips to Liberty, at a cost of $280 per truck load; and WHEREAS, Liberty found that its own contract trucking firm could transport said wood chips at lower cost of $220 per truck load, because of an efficient backhaul arrangement; and WHEREAS, the City entered into Agreement No. PW18-130 with Liberty Composting, Inc. to realize the available savings by having Liberty remove wood chips from the Facility; and WHEREAS, despite the City's continuous monthly advertising in farm industry publications for free wood chips, no other significant bulk outlets have been found to date; and WHEREAS, Liberty is willing to continue removing wood chips from the Facility under the terms of Agreement PW 18-130; and WHEREAS, the Public Works Director recommends the Council dispense with bidding requirements, in accordance with subsection D.2 of Section 3.20.060 of the Bakersfield Municipal Code. 9AKe of U p �,,.n..,.000 FiR191NAh Page�1 of 3 Pages NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Bakersfield as follows: 1. The City Council finds and declares that the foregoing recitals are true and correct and are hereby incorporated fully as a material part of this Resolution and based upon such matters, the City Council makes the additional findings set forth herein below. 2. The Finance Director is authorized to dispense with bidding in accordance with Section 3.20.060 of the Bakersfield Municipal Code. 3. The expenditure of funds for Liberty Composting, Inc. to haul the wood chips from Mount Vernon Green Waste Facility shall not exceed Two Hundred Forty Thousand Dollars ($240,000). 4.
