HomeMy WebLinkAboutORD NO 3120ORDINANCE NO. 3120 AN ORDINANCE OF THE COUNCIL OF THE CITY OF BAKERSFIELD AMENDING SECTION 2.72.130 OF THE BAKERSFIELD MUNICIPAL CODE RELATING TO NEPOTISM - APPOINTMENT OF SPOUSE OR RELATIVES. BE IT ORDAINED by the Council of the City of Bakersfield as follows: SECTION 1. Section 2.72.130 of the Bakersfield Municipal Code is hereby amended to read as follows: 2.72.130 Nepotism - Appointment of spouse or relative. The employment of relatives tends to cause problems in. sensitive areas of interdepartmental and intradepartmental rela- tionships, and can create undesirable results in connection with evaluation, performance and discipline. Because the problem of favoritism, whether real or imagined, exists and has a harmful effect upon employee morale and efficiency: Except as provided by paragraph four (4), there shall be no appointments, transfers or promotions to a position within the City or to a supervisory relationship either direct or indirect of any person who is a relative by marriage or by blood within the third degree of a permanent or probation- ary City employee, or of any person who lives in the same household as any other City employee. Except as provided by paragraph four (4), there shall be no appointments to a salaried position within the city of a relative by marriage or blood within the third degree of any member of the city council, boards, or commissions of the city. In the event that a permanent or probationary employee moves into the same household with or gets married to another permanent or probationary employee, and each wish to remain employed with the City, the Civil Service Commission shall review the matter on an indi- vidual basis and determine, as provided in paragraph four (4) whether both persons may remain as employees of the City. Appointments, transfers or promotions of persons who are related as provided above may be allowed if the appropriate civil service board determines that a conflict does not and will not exist. These provisions do not affect appointments, transfers, or promotions made prior to the adoption of these provisions. SECTION 2. This ordinance shall be posted in accordance with the City Charter provisions and shall become effective thirty (30) days from and after the date of its passage. .......... o0o ..........
