AN ORDINANCE OF THE COUNCIL OF THE CITY OF
BAKERSFIELD ADDING SUBSECTION G. TO SECTION
3.20.120 OF THE BAKERSFIELD MUNICIPAL CODE
RELATING TO DISPOSAL OF SURPLUS FIRE FIGHTING
EQUIPMENT.
BE IT ORDAINED by the Council of the City of Bakersfield
as follows:
SECTION 1.
Subsection G. is hereby added to Section 3.20.120 of the
Bakersfield Municipal Code to read as follows:
3.20.120 Surplus supplies and equipment.
G. Other provisions of this chapter not withstanding,
the Fire Chief may, on behalf of the City, donate used or outdated
firefighting handtools, hoses, and hose fittings, to any tax
exempt educational or charitable organization if he determines
that the City has no use for such equipment and that the recipient
has an evident need therefor. The Fire Chief shall obtain a writ-
ten waiver of liability from the recipient accepting the equipment
in an "as is" condition prior to transferring the same, and shall
report each such donation to the Council within thirty (30) days.
SECTION 2.
This ordinance shall be posted in accordance with the
City charter provisions and shall become effective thirty (30)
days from and after the date of its passage.

I HEREBY CERTIFY that the foregoing Ordinance was passed
and adopted by the Council of the City of Bakersfield at a regular
meeting thereof held on_ Auqust 26, 1987 , by the
