PUBLIC STATEMENTS 3. ADOPT FEBRUARY 5 AND MARCH 5 2018 AGENDA SUMMARY REPORTS The Commission adopted the February 5th and March 5th, 2018 agenda summary reports. Vice Chair Paterno motioned, Commission Flores second. Motion was unanimously approved. 4. NEW BUSINESS A. Review of the draft park vandalism PSA Chair Garcia and Commissioner Turner will be available to give a brief presentation to the City Council at the June 6 council meeting B. City Council Update – Youth Commission Status Report Commissioners relayed feedback on the overall commission. Staff recommends commissioners provide agenda items for consideration. Staff will be providing a status report to the City Council and will report back on council feedback. 5. COMMISSION COMMENTS No comments 6. ADJOURNMENT The meeting adjourned at 4:32 pm • MEMORANDUM Development Services Department Planning Division September 27. 1996 SUBJECT: GUIDELINES FOR MURALS~ ' In order to be cbnsistent'in our review of the murals planned in the downtown area. the following criteria will be considered: • A mural is not a sign and ther.efore. po permit is required; however, the Planning Department should review the drawing prior to it being painted to determine if it is a sign. If it identifies or advertises the business where the mural is located, or a business or product not on the site, the mural will be considered a sign and subject to the sign ordinance and permits. NOTE: A mural is defined as a picture, decoration, or abstract use of color. usually very large. applied directly to a wall or ceiling. A sign is defined as anything that brings attention to, identifies, or advertises a specific business. Although a mural brings attention itself and thus, indirectly to the site where it is located, it does not necessarily bring attention to a commercial product or business being conducted on the site if it is not depicting the product or service or representing graphically a commercial product or service. • If the mural depicts a scene or product that helps to define or represent a business or product that is on the same site as the mural, it will be considered a sign and the city's sign regulations would apply to the mural as to area coverage, etc .• (for example, a scene of old automobiles on the wall of a car dealership, bank scenes on a bank, produce on a grocery store, etc.). • The mural shall have no commercial advertisement, business name or logo, or any other commercial message of any kind. • A mural cannot incorporate within the artwork any existing commercial signs that would increase the businesses' exposure or advertisement. In accordance with the Guidelines, a mural is defined as a picture, decoration, or abstract use of color, usually very large, applied directly to a wall or ceiling. A sign is defined as anything that brings attention to, identifies, or advertises a specific business. Although a mural brings attention itself and thus, indirectly to the site where it is located, it does not necessarily bring attention to a commercial product or business being conducted on the site if it is not depicting the product or service or representing graphically a commercial product or service. A mural is not a sign, as such; murals are not subject to the sign ordinance or permitting. Staff uses the criteria noted below to consistently evaluate mural proposals. If any of the listed items are applicable, the proposal is a sign, not a mural. 1) Does the proposal identify or advertise the business where the proposal is located? 2) Does the proposal identify or advertise a business or product not on the site? 3) Does the proposal depict a scene or product that helps to define or represent a business or product that is on the same site as the proposal (for example, depiction of automobiles on the wall of a car dealership, bank scenes on a bank, produce on a grocery store)? 4) Does the proposal contain commercial advertisement, business name, or logo, or any other commercial message of any kind? 5) Does the proposal incorporate within the artwork any existing commercial signs that would increase the businesses' exposure or advertisement? In accordance with these guidelines, determinations have been made for each mural proposed (See Table 1).
