IF A PROBLEM OR CONFLICT SHOULD ARISE DURING THE COURSE OF THE PROJECT, IT IS THE RESPONSIBILITY OF THE OWNER OR THE CONTRACTOR TO NOTIFY THE ENGINEER IMMEDIATELY PRIOR TO ANY FURTHER WORK. 9. THE CONTRACTOR SHALL FURNISH ALL LABOR, MATERIALS, TOOLS, EQUIPMENT AND SUPERVISION NECESSARY FOR A COMPLETE AND FUNCTIONAL PRODUCT. 10. ALL WORK WHICH IS DEFECTIVE IN ITS CONSTRUCTION OR DEFICIENT IN ANY OF THE REQUIREMENTS OF THESE DRAWINGS AND SPECIFICATIONS SHALL BE REMEDIED, OR REMOVED AND REPLACED BY THE CONTRACTOR IN AN ACCEPTABLE. IN THE EVENT CONSTRUCTION STAKING BASED ON THE CONSULTANT'S PLANS, DRAWINGS OR OTHER DOCUMENTS IS ACCOMPLISHED BY ANYONE OTHER THAN THE CONSULTANT, THE OWNER OR CONTRACTOR SHALL NOTIFY THE BUILDING OFFICIAL IN WRITING AS TO THE CHANGE OF ENGINEER IN RESPONSIBLE CHARGE. 12. THE CONTRACTOR AGREES THAT HE SHALL ASSUME SOLE AND COMPLETE RESPONSIBILITY FOR JOB SITE CONDITIONS DURING THE COURSE OF CONSTRUCTION OF THIS PROJECT; INCLUDING EROSION, SEDIMENTATION & DUST CONTROL PLAN AND STORM WATER POLLUTION PREVENTION PLAN IMPLEMENTATION AND THE SAFETY OF ALL PERSONS AND PROPERTY; THAT THIS REQUIREMENT SHALL APPLY CONTINUOUSLY AND NOT BE LIMITED TO NORMAL WORKING HOURS; AND THAT THE CONTRACTOR SHALL DEFEND, INDEMNIFY AND HOLD THE OWNER AND THE ENGINEER HARMLESS FROM ANY AND ALL LIABILITY, REAL OR ALLEGED, IN CONNECTION 'NTH THE PERFORMANCE OF WORK ON THIS PROJECT, EXCEPTING FOR LIABILITY ARISING FROM THE SOLE NEGLIGENCE OF THE OWNER OR THE ENGINEER. 13. IF THE CONTRACTOR IS IN DOUBT AS TO THE MEANING OF ANY PART OF THE DRAWINGS AND SPECIFICATIONS OR FINDS DISCREPANCIES IN OR OMISSIONS FROM THE DRAWINGS, HE SHALL SUBMIT A WRITTEN REQUEST FOR AN INTERPRETATION OR A CORRECTION THEREOF, PRIOR TO FILING HIS BID PRICE FOR THE PROJECT. 14. PORTER & ASSOCIATES, INC. WILL NOT BE RESPONSIBLE OR LIABLE FOR UNAUTHORIZED CHANGES TO OR USES OF THESE PLANS. ANY AND ALL CHANGES TO THESE PLANS MUST BE APPROVED IN WRITING BY PORTER & ASSOCIATES, INC. 15. AN OPEN STREET PERMIT SHALL BE OBTAINED FROM THE CITY OF BAKERSFIELD PUBLIC WORKS DEPARTMENT FOR ANY WORK PERFORMED WITHIN EXISTING ACCEPTED STREET RIGHT OF WAY. THE SUBDIVIDER, IF REQUIRED, SHALL OBTAIN GRADING APPROVAL AS REQUIRED BY CITY OF BAKERSFIELD ORDINANCE, PRIOR TO START OF ANY EARTHWORK. 2. ANY TRENCHING TO BE CONDUCTED WITHIN THIS PROJECT SHALL BE BACKFILLED AND COMPACTED PER CITY STANDARD DETAIL ST -22. 3. THE CONTRACTOR SHALL REMOVE OR RELOCATE ALL OBSTRUCTIONS WITHIN THE STREET RIGHT-OF-WAY AS DIRECTED BY THE CITY ENGINEER. 4. ALL STREETS HAVE BEEN DESIGNED USING A MINIMUM "R" VALUE AS STATED IN THE SOILS REPORT. SEE STRUCTURAL SECTIONS FOR EACH STREET FOR SPECIFIC INFORMATION. SHOULD FURTHER TESTING SHOW A LOWER "R" VALUE OF THE ACTUAL IN PLACE MATERIAL, STREETS SHALL BE REDESIGNED ACCORDING TO THE LOWER "R" VALUE, IN ACCORDANCE WITH CITY ENGINEER. 5. RELATIVE COMPACTION OF NOT LESS THAN 95% SHALL BE OBTAINED FOR A MINIMUM DEPTH (T) OF 1.1 FOOT BELOW FINISH GRADE ON LOCAL STREETS (T=1.5' TO 2.5 AS DIRECTED BY THE PUBUC WORKS DIRECTOR ON COLLECTOR AND ARTERIAL HIGHWAYS) FROM LIP OF GUTTER TO LIP OF GUTTER. IN ADDITION, RELATIVE COMPACTION OF NOT LESS THAN 90% SHALL BE OBTAINED FOR A MINIMUM DEPTH OF 0.5 FEET BELOW GRADING PLANE FOR THE ENTIRE 'WIDTH OF PAVEMENT (LIP OF GUTTER TO LIP OF GUTTER). 6. THE CONTRACTOR SHALL OBTAIN 90% RELATIVE COMPACTION UNDERNEATH THE SIDEWALK AND CURB AND GUTTER TO A DEPTH OF 6". THE LOCATION OF THE TESTS SHALL BE DETERMINED BY THE CITY. 7. COMPACTION TESTS SHALL BE THE RESPONSIBILITY OF THE DEVELOPER. THE NUMBER AND LOCATION OF REQUIRED TESTS SHALL BE DETERMINED BY THE CITY ENGINEER. THE COST OF RETESTING DUE TO FAILED COMPACTION TESTS WILL BE BACKCHARGED TO THE CONTRACTOR. B. ALL CONCRETE SHALL BE CLASS 3 AND SHALL CONTAIN A MINIMUM OF 505 LBS./CU. YD. OF CEMENT AND HAVE A MAXIMUM WATER/CEMENT RATIO OF 0.50. 9. ASPHALT REJUVENATING AGENT SHALL BE APPLIED TO NEW ASPHALT CONCRETE PAVEMENT IN ACCORDANCE WITH THE PROVISIONS FOR FOG SEAL IN SECTION 37, BITUMINOUS SEALS, OF THE STATE DEPARTMENT OF TRANSPORTATION STANDARD SPECIFICATIONS, CURRENT EDITION, AND THE STATE DEPARTMENT OF TRANSPORTATION STANDARD SPECIAL PROVISIONS CURRENTLY IN EFFECT, AS DIRECTED BY THE CITY ENGINEER. 10. NEW STREETS SHALL BE EXTENDED AT INTERSECTIONS AS DIRECTED BY THE PUBLIC WORKS DIRECTOR IN ORDER TO PROVIDE A TIE INTO EXISTING STREET PAVEMENT. 11. SEWER LATERAL LOCATIONS TO BE STAMPED (S) INTO THE CURB FACE OVER EACH LATERAL. 12. ELEVATIONS AND GRADES SHOWN ON THE PROFILES ARE GUTTER FLOW LINES (INVERTS). 13. THE CONTRACTOR SHALL INSTALL PERMANENT TRAFFIC CONTROL SIGNING AND OTHER SAFETY DEVICES (NOT SHOWN ON THESE PLANS) TO MEET WHTH THE APPROVAL OF THE CITY PUBLIC WORKS DIRECTOR. THE PRICE FOR THIS ITEM SHALL BE INCLUDED IN THE PAVEMENT PRICE. 14. SIGN PANELS SHALL BE MOUNTED ON POSTS WITH HAWKINS M2G SERIES BOLT AND VANDAL PROOF NUT ASSEMBLY OR EQUAL, ROADSIDE SIGNS INSTALLED PER CITY STANDARD DETAIL T-19 SHALL BE LOCATED WITHIN SIDEWALK, 6" FROM BACK. 15. CONTRACTOR SHALL INSTALL BLUE MARKERS IN THE STREET AT THE FIRE HYDRANTS PER THE FIRE DEPARTMENT REQUIREMENTS. 16. CONTRACTOR SHALL COMPACT SUBGRADE TO 95% FOR FULL PAVEMENT SECTION TO AT LEAST 1.0 FT. UNDER AND EACH SIDE OF CROSS GUTTERS AND COMMERCIAL DRIVE APPROACHES. 17. PRIOR TO PAVING THE DESIGN ENGINEER FOR THE PROJECT SHALL VERIFY THAT CONDITIONS REMAIN THE SAME AS SHOWN IN THE APPROVED PLANS. SHOULD CONDITIONS BE CHANGED, A REVISED PLAN SHALL BE SUBMITTED TO THE CITY FOR APPROVAL 10 DAYS PRIOR TO PAVING. 18. LUMINAIRES SHALL BE SOLID STATE LIGHT EMITTING DIODE WITH TWIST LOCK PHOTOCELL (ORIENTED NORTH) AND SHALL CONFORM TO THE LATEST REQUIREMENTS OF THE CURRENT CITY OF BAKERSFIELD LED STREET LIGHTING SPECIFICATIONS. 19. WITH THE EXCEPTION OF THOSE ON RETURNS, STREET SIGNS AND STREET LIGHTS SHALL BE INSTALLED AT THE EXTENSION OF THE NEAREST LOT LINE TO WHERE THEY ARE SHOWN HEREIN. 20. MAXIMUM SLOPE RATIO FROM BACK OF SIDEWALK TO FACE OF WALL OR STRUCTURE SHALL BE 4:1, EXCEPT FOR TWO FEET BEHIND THE SIDEWALK WHERE THE MAXIMUM SLOPE SHALL BE 2%. ALTERNATIVELY, THE CITY ENGINEER MAY APPROVE CURBING BEHIND THE SIDEWALK OR OTHER METHOD TO PREVENT EROSION ONTO THE SIDEWALK. 21. CONTRACTOR SHALL STAMP AND "S" INTO CURB FACE OVER EACH SEWER LATERAL. 22. SEE WATER AND SEWER IMPROVEMENT PLANS FOR OTHER IMPROVEMENTS THAT ARE A PART OF THIS PROJECT COB ASPHALT CONCRETE PAVING NOTES 1. ASPHALT CONCRETE SHALL BE TYPE A (MODIFIED) FOR ALL ARTERIAL AND COLLECTOR STREETS AND TYPE B (MODIFIED) FOR LOCAL STREETS AND SHALL CONFORM TO THE PROVISIONS IN SECTION 39, "ASPHALT CONCRETE," OF THE CAL TRANS STANDARD SPECIFICATIONS AND THESE SPECIAL PROVISIONS. 2. PRIOR TO THE ADDITION OF ASPHALT BINDER, THE COMBINED MINERAL AGGREGATE FOR TYPE A (MODIFIED) OR TYPE 8 (MODIFIED) ASPHALT CONCRETE SHALL CONFORM TO THE REQUIREMENTS OF SECTION 39-2.02, "AGGREGATE," OF THE STANDARD SPECIFICATIONS FOR 3/4" MAXIMUM, MEDIUM GRADING. 3. ASPHALT BINDER FOR TYPE A (MODIFIED) ASPHALT CONCRETE AND TYPE B (MODIFIED) ASPHALT CONCRETE SHALL BE PG 64-10 PERFORMANCE GRADED ASPHALT, UNLESS OTHERWISE DIRECTED BY THE CITY ENGINEER. THE ASPHALT BINDER SHALL CONFORM TO THE REQUIREMENTS IN THE TABLE FOR PERFORMANCE GRADED ASPHALT BINDER, IN SECTION 92-1.02(B), "GRADES," OF THE STANDARD SPECIFICATIONS. 4. THE AMOUNT OF ASPHALT BINDER TO BE MIXED WITH THE MINERAL AGGREGATE SHALL BE DETERMINED BY THE CONTRACTOR IN ACCORDANCE WITH CALIFORNIA TEST METHOD 367 USING SAMPLES OF MATERIALS PROPOSED FOR USE IN THE WORK. THE AMOUNT OF ASPHALT BINDER SHALL BE APPROVED BY THE CITY ENGINEER. 5.
