HomeMy WebLinkAboutORD NO 3128ORDINANCE NO. 3128 NEW SERIES AN ORDINANCE OF THE COUNCIL OF THE CITY OF BAKERSFIELD AMENDING SECTION 17.06.020 OF CHAPTER 17.06 (ZONING MAP) OF THE MUNICIPAL CODE OF THE CITY OF BAKERSFIELD REGARDING PREZONING OF PROPERTY KNOWN AS THE BERKSHIRE NO.3 ANNEXATION. WHEREAS, in accordance with the procedure set forth in the provisions of Title 17 of the Municipal Code of the City of Bakersfield, the Planning Commission held hearings on a request by the City of Bakersfield to zone certain property now being annexed to said City and made several general and specific find- ings of fact which warranted a negative declaration of environ- mental impact; and WHEREAS, there appears to be no substantial detrimental environmental impact which could result from this zoning action; and WHEREAS, the proposed zoning substantially conforms to the General Plan; and WHEREAS, the City Council has determined after due con- sideration of the motion and recommendation of the Planning Commission, herein on file, together with the reasons advanced at the Planning Commission hearing, that said zoning should be authorized upon annexation of said property to the City. NOW, THEREFORE, BE IT ORDAINED by the Council of the City of Bakersfield as follows: A. All the foregoing recitals are found to be true and correct. B. The Negative Declaration for this zoning action is hereby approved and adopted. C. That Section 17.06.020 of Chapter 17.06 (Zoning Map) of the Municipal Code of the City of Bakersfield, be and the same is hereby amended by extending the boundaries of said map to include those certain properties in the County of Kern located contiguous to the boundary of the City of Bakersfield and located south of Panama Lane, easterly of South "H" Street, westerly of south Union Avenue, and north of Hosking Avenue and contiguous to the boundary of the City of Bakersfield, known as the BERKSHIRE NO. 3 ANNEXATION, upon the annexation of said property to the City of Bakersfield, the boundaries of which property are shown on the map hereto attached and made a part of this ordinance, are more specifically described as follows: FROM COUNTY A (EXCLUSIVE AGRICULTURE) ON 111.23 +/- ACRES AND COUNTY E (5) MHR R-S (ESTATE 5 ACRES MOBILEHOME COMBINING) ON 29.32 +/- ACRES TO CITY R-1 (ONE FAMILY DWELLING) Those portions of Lots 4, 13, 14, 17, 19, 20, 29, and 30 as shown on map of Berkshire Farm Tract in Section 30, Township 30 south, Range 28 east, M.D.B.&M County of Kern, State of California. Filed for record August 27, 1901, in the Office of the Kern County Recorder, more particularly described as follows: 18, Commencing at a point on the north line of said Section 30 from whence the northeast corner thereof bears east, 1,980 feet also being the northeast corner of said Lot 4; Thence south along the east line of said Lot 4, a distance of 30 feet to a point on the south right-of-way line of Panama Lane and the TRUE POINT OF BEGINNING: Thence continuing south along the east lines of said Lots 4 and 13, a distance of 1,456.02 +/- feet to a point on the south right-of-way line of the Arvin-Edison Canal; Thence east along last named south line, 660 +/- feet to a point on the east line of said Lot 14. EXCEPTING THEREFROM the dedicated road right-of-way for Berkshire Road and that right-of-way for the Arvin-Edison Canal. Containing 141.50 +/- acres (net acreage). Thence west, along said south line of Lot 18 and Lot 19, a distance of 990 +/- feet to the west line of the east half of Lot 19 also being a point on the north line and the west line of the east half of Lot 30; Thence south along the said west line of Lot 30, a distance of 1,290.96 +/- feet to a point on the north right-of-way line of Hosking Road; Thence west along said north line 990 +/- feet to a point on the west line of said Lot 29; Thence north along the west lines of Lots 29, 20, 13 and 4, a distance of 5,223.60 feet more or less to a point on the south right-of-way line of Panama Lane; Thence east, along said south line, 660 +/- feet to the TRUE POINT OF BEGINNING. EXCEPTING THEREFROM the dedicated road -3- right-of-way for Berkshire Road and that right-of-way for the Arvin-Edison Canal. Containing 141.50 +/- acres (net acreage). Subject to the following conditions of development: A portion of the site is south of the limits of streets shown on the Circulation Element of the General Plan. The Circulation Element shall be amended to include the following streets and corresponding designations as reflected in the proposed 2010 General Plan: South "H" Street (Panama Lane to McKee Road) Major Arterial; South Union Avenue (Panama Lane to McKee Road) Major Arterial; Monitor Street (Panama Lane to McKee Road) Major Collector; Berkshire Road (Renfro Road to Weedpatch Highway) Major Collector; Hosking Avenue (Renfro Road to Weedpatch Highway) Major Arterial. Upon development or subdivision and prior to issuance of a building permit or recordation of a tract or parcel map, each developer or subdivider shall pay his propor- tionate share of the costs for extension of Monitor Street across the Arvin-Edison Canal. Co Any development or subdivision within this GPA shall be connected to the municipal sewer system. The property owners shall participate in any Assessment District and/or Planned Sewer Area proceedings to provide sewer service to development within this area and the BerkshirE? numbers 1 and 2 annexations (adjacent to and west of this GPA area). There is an existing high voltage pole line on the south side of Panama Lane. Upon development or subdivision of the property adjacent to Panama Lane, the developer or subdivider shall relocate the pole line at his expense. To maintain safety clearances for the pole line, no buildings or structures are allowed within 25 feet of the relocated pole line. That area shall be labeled "RESTRICTED DEVELOPMENT AREA, CONTACT YOUR LOCAL PG&E LAND DEPARTMENT FOR APPROVED USES."
