RESOLUTION OF THE COUNCIL OF THE CITY
OF BAKERSFIELD RESCINDING RESOLUTION
NO.118-05.
WHEREAS, the California Subdivision Map Act grants the City authority to
extend vesting rights of a recorded map for one additional year beyond the
initial time period; and
WHEREAS, on June 8, 2005, the City Council of the City of Bakersfield
adopted Resolution No. 118-05, which enacted a policy to no longer grant
discretionary extensions of vesting rights for recorded maps; and
WHEREAS, that policy has become a burden on development and has
resulted in developers recording smaller phases at an increased cost; and
WHEREAS, City Council wants to encourage development and remove
burdensome barriers that make it less desirable to develop within the city of
Bakersfield; and
WHEREAS, allowing vesting rights to extend for one additional year will
help attain the goal of encouraging development, so City desires to rescind
Resolution No. 118-05.
NOW, THEREFORE, BE IT RESOLVED, by the Council of the City of Bakersfield
as follows:
The above recitals and findings are true and correct and are
incorporated herein by reference.
2. City Council hereby rescinds and declares void Resolution No. 118-
05.
3. This resolution shall take effect immediately upon its passage.
