A RESOLUTION DETERMINING THAT A REALICES WATER
TREATMENT SYSTEM CAN NOT BE REASONABLY OBTAINED
THROUGH THE USUAL BIDDING PROCEDURES AND
AUTHORIZINGTHE FINANCE DIRECTOR TO DISPENSE WITH
BIDDING THEREFOR AND PURCHASE A REALICES WATER
TREATMENT SYSTEMS FROM CYPRESS, LTD., NOT TO
EXCEED $62,000 DOLLARS.
WHEREAS, the Rabobank Arena staff desires to reduce staff maintenance time and
operation costs for ice building and resurfacing at the facility; and
WHEREAS, a patented water treatment system known as Realice® eliminates the need
for hot water when building and resurfacing ice; and
WHEREAS, the energy savings related to surfacing with cold water result in less natural
gas and electricity used as well as staff labor savings due to less cleanings necessary; and
WHEREAS, AEG staff has determined the installation of a RealiceS systems will
substantially save in operations cost and will reduce greenhouse emissions; and
WHEREAS, the patented system, RealiceS can only be purchased through the exclusive
importer and sole distributor, Cypress LTD.; and
NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Bakersfield as follows:
The above recitals are true and correct and incorporated herein by reference.
2. The Council hereby finds that the purchase of RealiceS water treatment systems
can only be reasonably obtained from one vendor, Cypress LTD for the reasons set forth
above.
3. The Finance Director is authorized to dispense with bidding in accordance with
Section 3.20.060 of the Bakersfield Municipal Code.
