A RESOLUTION OF THE CITY OF BAKERSFIELD REPEALING RESOLUTION
NO. 053.09 RELATED TO THE MORNING DRIVE -COLLEGE AVENUE
PLANNED BRIDGE AND MAJOR THOROUGHFARE AREA AND MAKING
FINDINGS RELATIVE THERETO.
WHEREAS, on May 6, 2009, the City Council adopted Resolution No. 053-
09, establishing the Morning Drive -College Avenue Planned Bridge and Major
Thoroughfare Area as a fee collection tool to finance designated roadway
improvements in the Northeast; and
WHEREAS, the newly constructed Morning Drive/SR 178 interchange now
provides access to south of SR 178 that did not exist in 2009; and
WHEREAS, since access to a majority of the district area has been
provided, any remaining roadway improvements designated in the district area
are no longer necessary; and
WHEREAS, since no additional roadway improvements are necessary, the
need for the Morning Drive -College Avenue Planned Bridge and Major
Thoroughfare Area as a reimbursement mechanism is no longer needed; and
WHEREAS, there are no collected fees remaining in the district.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL, AS FOLLOWS:
Section 1. The City Council finds and determines that the foregoing
recitals are true and correct.
Section 2. Resolution No. 053-09 is hereby repealed and proceedings
thereunder are abandoned.
Section 3. This resolution shall take effect from and after its passage and
adoption.
