A RESOLUTION DETERMINING THAT PRECAST PLANKS WITH
WOOD TEXTURE CANNOT BE REASONABLY OBTAINED
THROUGH THE USUAL BIDDING PROCEDURES AND
AUTHORIZING THE FINANCE DIRECTOR TO DISPENSE WITH
BIDDING THEREFOR, NOT TO EXCEED $50,000.
WHEREAS, the Recreation and Parks Department needs to replace multiple
precast concrete wall planks in the area of Wible Road and Panama Lane; and
WHEREAS, Structure Cast, Bakersfield, possesses unique molds exclusively for
their use to manufacture these wall planks; and
WHEREAS, the City must replace deteriorated or damaged wall sections with
planks to match existing wall sections; and
WHEREAS, Structure Cast, Bakersfield, originally provided the concrete wall
planks and can replicate replacement wall planks currently; and
WHEREAS, the Recreation and Parks Director has determined and has
recommended the Council find, that the purchase of precast concrete wall planks
can only be reasonably obtained from one vendor, Structure Cast, Bakersfield,
because of exclusive molds and has recommended that this Council authorize
dispensing with bidding requirements in accordance with subsection D.2 of Section
3.20.060 of the Bakersfield Municipal Code.
NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Bakersfield as
follows:
1. The above recitals are true and correct and incorporated herein by
reference.
2. The Council hereby finds that the purchase of precast concrete wall
planks to be used for replacement, can only be reasonably obtained from one
vendor, Structure Cast, Bakersfield, for the reasons set forth above.
3. The Finance Director is authorized to dispense with bidding therefore in
accordance with Section 3.20.060 of the Bakersfield Municipal Code and to
negotiate the purchase of same for an immediate purchase not to exceed $50,000.
