A RESOLUTION DISPENSING WITH BIDDING
PROCEDURES DUE TO EMERGENCY REPAIRS AT THE
SEWER LIFT STATION ON MCCUTCHEN ROAD JUST
EAST OF GOSFORD ROAD, AND AUTHORIZING
RAIN FOR RENT AND W.M. LYLES COMPANY TO
PERFORM NECESSARY REPAIRS, NOT TO EXCEED
SEVENTY FIVE THOUSNAD DOLLARS ($75,000) -
WHEREAS, On Sunday August 4th 2019, the sewer lift station on McCutchen
Road just east of Gosford Road failed and raw sewage backed up into the dry
well portion of the lift station causing damage to both electrical components and
pumps; and -
WHEREAS, upon investigation, Streets Division staff determined the failure
was the result of a defective computer component causing sewage to enter
through an opening around a pipe that was approximately 20 feet above normal
sewer flow, and that two of the five pumps were damaged from being
submerged in raw sewage and required to be reconstructed; and
WHEREAS, the Public Works Director was informed that the repairs could not
be made by City staff alone; and
WHEREAS, after assessing the condition of the McCutchen Road lift station,
the Public Works Director declared these conditions to be an emergency
requiring work, supplies equipment and materials urgently necessary for the
preservation of life, health and property; and
WHEREAS, to remedy this emergency, the Public Works Director authorized
Rain for Rent to set up a by-pass for sewer and W.M. Lyles to do repairs to prevent
further deterioration of the lift station; and
WHEREAS, W.M. Lyles was authorized by the Public Works Director to repair
the lift station on a time and material basis since it had the necessary material,
equipment and expertise to repair the lift station in order to get it back in
operation as soon as possible.
NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Bakersfield
as follows:
1. The City Council finds and declares that the foregoing recitals are
true and correct and are hereby incorporated herein by reference.

2. Based on the facts included in the above recitals, the work
performed by Rain for Rent and W.M. Lyles Co was of urgent
necessity for the preservation of life, health or property, thereby
allowing the dispensing of bidding requirements as set forth in Section
136 of the City Charter and Section 3.20.060 of the Bakersfield
Municipal Code.
3. The Finance Director is authorized to dispense with bidding in
accordance with Section 3.20.060 of the Bakersfield Municipal Code.
4. The expenditure of funds to Rain for Rent and W.M. Lyles Co
described herein for the work, supplies, equipment and materials
must not exceed Seventy Five Thousand Dollar ($75,000).
