RESOLUTION DISPENSING WITH BIDDING UNDER SECTION
3.20.060(D)(5) OF THE BAKERSFIELD MUNICIPAL CODE
RELATING TO THE DESIGN/BUILD CONSTRUCTION
PROCUREMENT PROCESS FOR THE REGIONAL PUBLIC
SAFETY COMMUNICATIONS NETWORK IN PARTNERSHIP
WITH THE COUNTY OF KERN WHICH WILL PROVIDE
ONGOING REAL-TIME COMMUNICATIONS FOR
BAKERSFIELD POLICE AND FIRE PUBLIC SAFETY
PERSONNEL.
WHEREAS, in March of 2015, the Technology Services division contracted a
consultant to evaluate the City's aged public safety land mobile radio system;
and
WHEREAS, the consultant's findings were that the land mobile radio system
would no longer have manufactures support beyond December 2018 and
recommended replacing the system with a modern digitally trunked system; and
WHEREAS, the County of Kern's public safety land mobile radio system is in
a similar state needing upgrading and ongoing support; and
WHEREAS, the City of Bakersfield and the County of Kern determined the
best course of action was to partner on development of a Regional Public Safety
Communications Network; and
WHEREAS, the City of Bakersfield and the County of Kern would like to issue
a joint Request for Proposal using the design/build methodology for the Regional
Public Safety Communications Network; and
WHEREAS, the use of the design/build methodology has been shown to be
an effective method of reducing design and construction costs; and
WHEREAS, the use of design/build joins the construction and design of a
project under one single legal entity thereby reducing conflicts; and
WHEREAS, the City Council believes the use of design/build is appropriate
for certain unique projects where specialized design and construction methods
are necessary and expertise must be employed; and
WHEREAS, the City Council believes the public and the procurement
process can be adequately protected through the use of a fair competitive

process for choosing a design/build entity which best serves the interests of the
City. and
NOW, THEREFORE, BE IT RESOLVED, by the Council of the City of Bakersfield
as follows:
1. The above recitals are true and correct and are incorporated herein
by reference.
2. The Regional Public Safety Communications Network project is
appropriate for design/build because of the specialized nature of
the design and construction of the project.
3. The Regional Public Safety Communications Network project justifies
an exception to the bidding process and the City Council hereby
determines that the work, supplies, equipment and material can best
be obtained through the design/build construction procurement
process.
4. Upon adoption of this Resolution, the City Manager is authorized to
proceed with the design/build procurement process, as set forth in
the Bakersfield Municipal Code Section 3.20.060(D)(5) for the
Regional Public Safety Communications Network project.
5. The City Manager shall recommend a design/build entity that
combines appropriately licensed contracting, architectural and
engineering services, as needed, into one legal entity.
6. The City Manager shall invite no less than three appropriate
design/build entities to participate in the selection process.
7. The City Manager shall, in a timely manner, bring the contract for
award of the project to the City Council for approval with a report
setting forth the reasons the award is recommended to the chosen
design/build entity.
