SUBJECT: NEPOTISM RULING -MATTHEW BARNES
CANDIDATE FOR CIVIL ENGINEER III -TRAFFIC #01257
Matthew Barnes has successfully competed in the Civil Engineer III - Traffic examination
process and placed on the Eligibility List for same. His father, Kevin Barnes, is currently
employed as a Solid Waste Director in the Solid Waste Division of the Public Works
Department. Due to the possibility of Matthew being considered for the Civil Engineer III -
Traffic position in the Administration Division of the Public Works Department, the issue of
nepotism must be addressed.
The following information has been compiled for your review and determination whether
nepotism creates an adverse impact on supervision, safety, security or morale.
SUMMARY OF DUTIES
A summary of the duties and responsibilities for Civil Engineer III is as follows: Under direction,
is responsible for technical work examining building plans for compliance with building code
and zoning regulations, or participates.in and is'in charge of varied and difficult professional
engineering work of the more advanced level including research and design of engineering
projects; and performs other work as required.
A summary of the responsibilities for Solid Waste Director is as follows: Under administrative
direction is responsible for planning and directing the general operation of municipal solid
waste collection, including treatment, disposal, diversion, and recycling programs; plans,
organizes, integrates, directs and coordinates activities of the Solid Waste Division; provides
assistance to the Department Head with work of great complexity and sensitivity; makes
public presentations and responds to public inquiries; acts as the division head and is
assigned responsibility for specific functional areas; provides policy guidance and maintains
cooperative relationships with community groups, intergovernmental agencies and City
staff. Under direction, acts for Department Head in their absence.
EMPLOYMENT OVERLAP
According to the Public Works Director, Nick Fidler, if Matthew Barnes is appointed to the Civil
Engineer III - Traffic. position in the Administration Division of the Public Works Department,
performance appraisals would not be reviewed or conducted by either employee for the
other, neither employee would be directly supervised by the other, and they would not report
to. each other within the chain of command as they would. be assigned to different divisions.

The Public Works Director, Nick Fidler and the Human Resources Division recommend

Omar Garcia is competing in the examination process for Construction Inspector 1/II. His wife, Connie Garcia,
is currently employed as a Clerk Typist I in the Fleet Division of the Public Works Department. Due to the
possibility of Omar being considered for appointment to a Construction Inspector 1/II position, the issue of
nepotism must be addressed.
The following information has been compiled for your review and determination of whether nepotism creates
an adverse impact on supervision, safety, security or morale.
SUMMARY OF DUTIES
A summary of the responsibilities for Construction Inspector 1/II is as follows: Under general supervision, performs
detailed inspection of Public Works construction projects; interprets plans and specifications to endure contract
compliance; prepares and recommends change orders and cost estimates.
A summary of the duties and responsibilities for the position of Clerk Typist I is as follows: Under immediate
supervision, performs routine and repetitive typing and clerical duties; and performs other work as required.

According to the Assistant Public Works Director, Stuart Patteson, if Omar Garcia is appointed to a Construction
Inspector 1/II, in the Construction .Division, performance appraisals would not be reviewed or conducted by

CANDIDATE FOR CONSTRUCTION INSPECTOR 1/11 #01272
Bryan Harrington is competing in the examination process for Construction Inspector 1/II. His brother, Chris
Harrington, is currently employed as a Wastewater Plant Mechanic in the Wastewater Division of the Public Works
Department and his father, Martin Harrington, is currently employed as a Light Equipment Operator in the Recreation
&, Parks Department. Due to the possibility of Bryan being considered for appointment to a Construction Inspector
1/11 position, the issue of nepotism must be addressed. Bryan Harrington is currently employed as a Survey Party Chief
1 in the Engineering Division of the Public Works Department. -
The following information has been compiled for your review and determination of whether nepotism creates an
adverse impact on supervision, safety, security or morale.
SUMMARY OF DUTIES
A summary of the responsibilities for Construction Inspector 1/II is as follows: Under general supervision, performs
detailed inspection of Public Works construction projects; interprets plans and specifications to endure contract
compliance; prepares and recommends change orders and cost estimates.
A summary of the duties and responsibilities for the position of Wastewater Plant Mechanic is as follows: Under
supervision, performs skilled journeyman -level work in the maintenance and repair of wastewater treatment plant
and pumping station equipment, gasoline, methane, and propane engines, sewage/waste grinders, sludge and grit
collection mechanism, blowers, equipment controllers, and other plant and pump station equipment; operates light
and heavy equipment, maintains parts inventory and equipment records; and performs related work as required.
A summary of the duties and responsibilities for the position of Light Equipment Operator - Parks is as follows: Under
general supervision, performs semiskilled work in the operation of light and heavy equipment and complex
equipment such as graders, backhoes, three. and seven gang mowers, and heavy dump trucks, towing trailers, front
loaders with sand bucket and clamshell implements. Performs other work as required.
EMPLOYMENT OVERLAP
According to the Assistant Public Works Director, Stuart Patteson, if Bryan Harrington is appointed to a Construction
Inspector I/11; in the Construction Division, performance appraisals would not be reviewed or conducted by any
relative employee, no relative employee would be directly supervised by the other, :and they would not report to
each other within the chain of command as they would be assigned to different divisions.
RECOMMENDATION

Jennifer Byers has successfully competed in the Development Services Director examination. Her daughter,
Emily Whinery; is currently employed as a Recreation Specialist in the Recreation and Parks Department. Due
to the possibility of Jennifer being considered for appointment to a Development Services Director, the issue
of nepotism must be addressed.
