A RESOLUTION DISPENSING WITH BIDDING
PROCEDURES, AUTHORIZING AMERICAN
EMERGENCY PRODUCTS (AEP) CALIFORNIA TO
OUTFIT POLICE VEHICLES, AND AUTHORIZING
FINANCE DIRECTOR TO DISPENSE WITH BIDDING
NOT TO EXCEED ONE MILLION FIVE HUNDRED AND
FIFTY THOUSAND DOLLARS ($1,550,000) DUE TO
PUBLIC SAFETY CONCERNS
WHEREAS, Council accepted a bid to purchase 73 Ford Police Interceptor
Utility Vehicles from Jim Burke Ford at the September 25, 2019 Council meeting;
and
WHEREAS, since the vehicles from Ford do not come with the unique
specialized equipment required for Police activities, the City must outfit the police
vehicles with the required equipment; and
WHEREAS, given the current staffing levels and ongoing workload of the
Fleet Division, it is necessary to find a more efficient process for police vehicle
outfitting; and
WHEREAS, in 2019, Fleet services performed a pilot program to send 5
vehicles to AEP California, a San Diego area company; and
WHEREAS, AEP California is able to provide safety features in the vehicles
City staff was not able to provide; and
WHEREAS, City will have 30 new Public Services Vital Services Measure
(PSVS) funded officers that will need vehicles by May 2020. PSVS funds funded 25
vehicles and the remainder of the Ford vehicles approved for purchase include
vehicle replacements; and
WHEREAS, the order for the 73 police vehicles that were approved by
Council at the September 25, 2019 Council meeting is on hold because Ford
cannot start the order without the location where the vehicles will be shipped for
additional outfitting, and production time from Ford is between 2-3 months from
the date the order is placed; and
WHEREAS, vendor selection by a Request For Qualifications and Proposal
(RFQ/ RFP) will delay the order from Ford by approximately five to six additional
weeks.

NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Bakersfield
as follows:
Based on the facts included in the above recitals, the work
performed by AEP California is of urgent necessity for the
preservation of life, health or property, thereby allowing the
dispensing of bidding requirements as set forth in Section 136 of the
City Charter and Section 3.20.060 (D) (4) of the Bakersfield Municipal
Code.
2. The Finance Director is authorized to dispense with bidding in
accordance with Section 3.20.060 of the Bakersfield Municipal Code.
3. The expenditure of funds to AEP California described herein for the
work, supplies, equipment and materials must not exceed One Million
Five Hundred Fifty Thousand Dollars ($1,550,000).
