AN ORDINANCE OF THE COUNCIL OF THE CITY OF
BAKERSFIELD AMENDING SECTION 17.06.020 OF
CHAPTER 17.06 (ZONING MAP) OF THE MUNICIPAL
CODE OF THE CITY OF BAKERSFIELD REGARDING
PREZONING OF PROPERTY KNOWN AS A PORTION OF
THE BERKSHIRE NO. 1 ANNEXATION.
WHEREAS, that certain property known as the Berkshire
No. 1 Annexation was heretofore prezoned by Ordinance No. 3099
New Series;
WHEREAS, in accordance with the procedure set forth in
the provisions of Title 17 of the Municipal Code of the City of
Bakersfield, the Planning Commission held hearings on a request
by the City of Bakersfield to amend said prezoning for a portion
of the Berkshire No. 1 Annexation and made several general and
specific findings of fact which warranted a negative declaration
of environmental impact; and
WHEREAS, there appears to be no substantial detrimental
environmental impact which could result from this zoning action;
and
WHEREAS, the proposed zoning substantially conforms to
the General Plan; and
WHEREAS, the City Council has determined after due
consideration of the motion and recommendation of the Planning
Commission, herein on file, together with the reasons advanced
at the Planning Commission hearing, that said prezoning should
be amended and authorized upon annexation of said property to
the City.
NOW, THEREFORE, BE IT ORDAINED by the Council of the
City of Bakersfield as follows:
A. All the foregoing recitals and those set forth in
Planning Commission Resolution No. 16-88 are found to be true and
correct.
B. The Negative Declaration for this zoning action is
hereby approved and adopted.
C. That Section 17.06.020 of Chapter 17.06 (Zoning Map)
of the Municipal Code of the City of Bakersfield, be and the same
is hereby amended by extending the boundaries of said map to
include those certain properties in the County of Kern located
contiguous to the boundary of the City of Bakersfield and located
north of Hosking Road, east of Highway 99 and south of the Arvin-
Edison Canal, known as a portion of the BERKSHIRE NO. 1 ANNEXATION,
upon the annexation of said property to the City of Bakersfield,
the boundaries of which property are shown on the map hereto
attached and made a part of this ordinance, and are more specifi-
cally described as follows:
FROM AN M-1 (LIGHT MANUFACTURING PREZONE
TO AN M-2 (GENERAL MANUFACTURING) ZONE:
That portion of Lots 9 and 10 of Section
30, Township 30 south, Range 28 east in
the County of Kern, State of California
as shown on map of Berkshire farm tract
filed August 27, 1901 in Book 1 of maps
at Page 38 in the office of the Kern
County Recorder, more particularly
described as follows:
Commencing at the west quarter corner of
said section 30 also being the southwest
corner of said lot 10 and also being the
point of intersection of the center lines
of Berkshire Road (Co. Rd., No. 354) and
South "H" Street (Co. Rd. No. 140), both
roads being 60 feet wide;
Thence east along the south line of said
lot 10 and also being the center line of
Berkshire Road 30 feet to the east line
of the west 30 feet of said section 30
and also being the east line of the west
30 feet of said lot 10 and the southerly
extension of the east line of the west 30
feet of said lot 9;
Thence north along last named east line
30 feet to the north line of Berkshire
Road and the True Point of Beginning:
Thence continuing north along last named
east line 1,291.61 feet to the north line
of said lot 9;
Thence north 89030'47" east, along the
north line of said lot 9, 959.38 feet to
a point;
Thence south 00°37'13" west, 1,291.68
feet to a point on the north right-of-way
of said Berkshire Road said point being
30.00 feet north of the south line of
said lot 10;
Thence north 89030'34" west, 60.00 feet
along the said north right-of-way line;
Thence north 00°37'13" east, 316.80 feet;
Thence north 89°33'52" west, 725.31 feet;
Thence south 00°37'13" west, 316.11 feet
to the north right-of-way of Berkshire
Road;
Thence north 89°30'34" west, 174.06 feet
along the north right-of-way of said
Berkshire Road to the True Point of
Beginning.
Containing 23.18 acres, more or less.
This ordinance shall become effective upon the annexa-
tion of the above-described territory to the City of Bakersfield.

I HEREBY CERTIFY that the foregoing Ordinance was passed
and adopted by the Council of the City of Bakersfield at a regular
meeting thereof held on February 17, 1988 , by the
