AN ORDINANCE OF THE COUNCIL OF THE CITY OF
BAKERSFIELD ADDING SECTION 13.04.265 TO THE
BAKERSFIELD MUNICIPAL CODE RELATING TO ADDI-
TION OF TERRITORY TO MAINTENANCE DISTRICTS.
BE IT ORDAINED by the Council of the City of Bakers-
field as follows:
SECTION 1.
Section 13.04.265 of the Bakersfield Municipal Code is
hereby added to read as follows:
13.04.265 Addition of territory - Resolution - Hearing.
A. Following a noticed hearing thereon, additional
territory may be added to an established maintenance district. If
such additional territory is to be assessed for maintenance and
operation of public improvements either (1) located entirely within
the previously established district or (2) located within the ter-
ritory to be added to the established district (the maintenance and
operation expenses of which shall be assessed solely against such
additional territory), notice required by this chapter need be
given only to owners of record of property within the additional
territory; otherwise, notice shall be given as well to owners of
record of property within the established maintenance district.
B. The City Council shall by resolution fix a time
for hearing on the question of adding additional territory to an
existing maintenance district.
SECTION 2.
This ordinance shall be posted in accordance with the
City charter provisions and shall become effective thirty (30)
days from and after the date of its passage.
