Except as provided in Section 15.84.090 of this chapter, any person who applies to the city for the issuance of a building permit to make an improvement to land for one of the uses which is specified in the current resolution adopting the Transportation Impact Fee Schedule, and which will generate or attract additional traffic, shall be required to pay a transportation impact fee in a manner and amount set forth in this chapter provided that the land development activity is consistent with the designations of the Metropolitan Bakersfield General Plan.” * * * “D. In the event of development that necessitates a general plan amendment, the transportation impact fee shall be determined independently of the fee schedule adopted by resolution and shall be based on the actual impacts of said development. The independent study shall measure the impact of the development in question on the road system by following the prescribed methodologies and formats for the study established by the administrator.” * * * The purpose and intent of Mitigation Measure 5.11.A.1 and 6.3.11.A.1 is to require the developer to mitigate traffic impacts by participating in the Regional transportation Impact Fee Program in the manner specified by Bakersfield Municipal Code Section 15.84.040, which includes the policies of the program administrator. The modifications required by McIntosh & Associates are will be consistent with that purpose and intent with the following modifications. In a meeting with City staff, the project proponent agreed to either a) pay the current Regional Transportation Impact Fee as modified by the Construction Cost Index (CCI), or b) pay their calculated Regional Impact Fee AND pay a local transportation impact mitigation fee determined as follows: The local mitigation fee shall be based upon the proponent’s share of the cost to upgrade the significantly impacted facilities to the lower of Level of Service C or the level of service currently existing, and shall be adjusted annually by the CCI in the same manner as the Regional Transportation Impact Fee. The cost of the upgrade shall be estimated based on the City’s actual costs including, but not limited to, all costs of obtaining and clearing right-of-way, all utility relocations, and all construction. Construction shall include but not limited to: curb, gutter, sidewalk, pavement, signal modification, landscape and wall replacement, drive approaches, catch basin replacement, additional storm drain where necessary, streetlights, striping and signing.
